ST. JOHN'S }
To Wit          } I do swear that I believe that Philip Hutchins, late of St. John's in the Central District of Newfoundland, Merchant, deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One Hundred and Fifty Thousand dollars.

TO ALL TO WHOM these presents shall come, I, Arthur Burch Esquire, Mayor and Chief Magistrate of the City of Exeter in that part of Great Britain called England, Do hereby certify that on the day of the date hereof personally came and appeared before me Nancy Knowling, the Deponent named in the affidavit hereunto annexed being a person well known and worthy of good credit and by her affidavit which she then made before me did swear to be true the several matters and things contained in her said affidavit.
In faith and testimony whereon, I the said Mayor and Chief Magistrate have caused the Common Seal of the said City of Exeter to be hereunto put and affixed. And the said Affidavit to be hereunto annexed.

In re: the Goods of Philip Hutchins, late of
St. John's in the Central District of the
Island of Newfoundland, Merchant, deceased.

I Nancy Knowling of No. 1 Polsloe Villas, South Avenue in the City of Exeter in England, Spinster, make oath and says as follows:

  1. I am a Niece of the above named Philip Hutchins, deceased, and for Eight years and upwards prior to his death which happened at Exeter aforesaid on the 27th day of April 1886, I resided with him as *his relation and companion and acted as his House Keeper. (*Initials RJ? and AM in left margin)
  2. In or about the month of January 1879 the said Philip Hutchins gave me certain shares in the "Union Bank of Newfoundland" in Saint John's aforesaid now represented by 30 shares of 100 dollars each in the same Bank and certain shares in the "Commercial Bank of Newfoundland" in Saint John's aforesaid now represented by 3 shares of £50 currency each in the same Bank and the said Philip Hutchins caused the said shares to be transferred into my name in the Books of the said Banks respectively and the same have ever since been and still are standing in my name in the said Books and I hold the Certificates for the same.
  3. The said shares were given to me by the said




    deceased in consideration of his natural affection for me and to make some provision for me.
  4. The Dividends and bonuses payable in respect of the said shares respectively were from time to time received by me during the lifetime of the said Philip Hutchins and were by me lent to him to be employed in his business on the understanding that they should be repaid whenever I required them.
  5. The said Dividends and bonuses are more particularly specified in the Schedule hereunder written and amount to £818 (currency of Newfoundland).
  6. The said sum of £818 is now justly due and owing to me from the Estate of the said Philip Hutchins, deceased.

Be it Remembered, That on this Thirtieth day of September in the Forty Fiftieth Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-six personally appeared George Knowling, The Honourable Augustus W. Harvey, James Murray, Robert H. Prowse and Arthur S. Rendell, all of Saint John's in the Central District of the Island of Newfoundland, Merchants, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Three Hundred Thousand Dollars, to be had, made and levied on their Goods, Chattels and Effects,  jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden George Knowling, as Administrator of the Estate and Effects of Philip Hutchings late of Saint John's aforesaid, Merchant, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said George Knowling as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 30th day of March next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said George Knowling or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 30th day of September which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Upon reading the Petition of George Knowling and upon hearing Mr. Morison of counsel for him, I do order that the said George Knowling to file his accounts as Administrator ad Colligendum bona of the Estate of said Philip Hutchins deceased and I do further order that upon the filing of the said accounts Administrator in Common form of the Estate of Philip Hutchins, deceased, be granted to the said George Knowling.
Dated at St. John's this 29th day of July A.D. 1886.

The Petition of George Knowling of Saint John's, Merchant

Humbly Sheweth

          That Administration ad colligendum bond of the Estate of late Philip Hutchins, deceased, was granted to Petitioner by the Honourable the Chief Justice on the tenth day of May last.

That annexed hereto is a copy of the petition upon which said Administration was granted.

That annexed hereto is the consent of several of the next of kin of said deceased to the grant of full Administration to Petitioner.

That to the best of deponents Petitioner's knowledge and belief the probable value of the property and effects of which said deceased died possessed is one hundred thousand dollars.

Petitioner therefore prays that full administration of the Estate of said deceased may be granted to him

And as in duty bound he will ever pray &c.

WHEREAS Philip Hutchins, late of Saint John's in the Central District of the Island of Newfoundland, Merchant, deceased, died on the 27th day of April 1886 at Elmside House in the City of Exeter in England, a widower without child or parent and intestate leaving Nancy Chown (wife of Charles Chown) his natural and lawful sister and only next of kin and several children of his deceased Brothers and sisters who, together with the said Nancy Chown are entitled to share in the distribution of his personal estate him surviving AND WHEREAS on the Tenth day of May 1886 the Supreme Court of Newfoundland nominated and appointed George Knowling of Saint John's in the Central District of the Island of Newfoundland aforesaid, Merchant, Administrator ad Colligendum bona defunct within the said Island of Newfoundland and its dependencies with the powers and authorities therein mentioned as by the Records of the said Court, will appear AND WHEREAS the said George Knowling is a lawful Nephew of the said deceased being one of the children of his deceased sister Elizabeth Knowling (wife of George Knowling) who died on the twenty second day of May 1879 and as such is one of the persons entitled to share in the distribution of the personal estate of the said deceased and the undersigned Nancy Chown is desirous of appointing him, the said George Knowling, her Attorney for the purpose of his applying in the aforesaid Supreme Court of Newfoundland for a General Grant of Administration of the personal Estate of the said deceased NOW the said Nancy Chown, the natural and lawful sister and only next of kin of the said deceased, at present residing at Attica Lapeer in the County of Michigan in the United States of America do hereby nominate, constitute and appoint my Nephew, the said George Knowling, who is also a Nephew of the said deceased as aforesaid, to be my lawful Attorney for the purpose of his obtaining a General Grant of Letters of Administration of the personal estate of the said Intestate to be granted to him by the Supreme Court of Newfoundland for my use and benefit and until I shall duly apply for and obtain Letters of Administration of the personal estate of the said intestate to be granted to me AND I hereby promise to ratify and confirm whatever my said Attorney shall lawfully do or cause to be in the Premises.
IN WITNESS whereof I have hereunto set my hand and seal this 19th day of June in the year of our Lord 1886.

The Petition of George Knowling of Saint John's.

Humbly Sheweth

          That Philip Hutchins, late of Saint John's, Merchant, died at Exeter in England on the twenty seventh day of April now last past.
That said deceased up to the time of his death was carrying on a large general mercantile business in Saint John's but had no partners in the said business.
That said deceased left no wife or child.
That said deceased left him surviving as next of kin one sister Mrs. Chown resident in the United States and twelve nephews and nieces viz:- four daughters and two sons of a deceased sister Elizabeth Knowling, one daughter of a deceased sister Mrs. Ruddan, and four sons and one daughter of a deceased brother, Henry Hutchins.
That of the said nephews and nieces

 

only three are resident in Newfoundland namely Philip H., son of said Henry Hutchins, William Knowling, brother of your Petitioner and your Petitioner.
That so far as Petitioner has been able to learn, both by inquiries of those who were with the said deceased up to the time of his death and in attendance upon him and otherwise, the said deceased died without having made any will.
That your Petitioner has been in the employ of deceased in Saint John's for twenty years and for about twelve years past has been the confidential and managing agent of the deceased and in his said business and during the absence of the deceased from Saint John's the entire control and management of said business from time to time have devolved upon your Petitioner.
That your Petitioner believes that the whole value of the Estate and property of which deceased was possessed at the time of his death was from one hundred and eighty to two hundred thousand dollars of which about fifty thousand dollars is in money and investments in England and the remainder is in Newfoundland.
That it is of urgent importance in the interest

 

of the said business and estate and of all who may be entitled thereto that the same should be vested in some person having authority to hold and realize the same.
Your Petitioner therefore prays that Letters of Administration of the estate of said deceased may be granted to your Petitioner either in full, or subject to such limitations and directions as to your Honourable Court or your Lordship may seem met?
And your Petitioner as in duty bound will ever pray &c.
