AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of Henry Heath, late of Saint John's in the Central District of Newfoundland, Shoe-maker, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Henry Heath , deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Eight Hundred Dollars.

So help you God.

The Petition of Nancy Barnes Heath St. John's in the Island of Newfoundland, Widow.

Humbly Sheweth

          That your Petitioner's Husband Henry Heath late of St. John's Shoemaker died on or about the Seventh day of October Anno Domini one thousand eight hundred and eighty four leaving him surviving your Petitioner and three children.
          That at the time of the decease of the said Henry Heath he was possessed of property and effects of the probable value of Eight Hundred Dollars.
          That said deceased prior to his decease made and published his last will and testament which has been proven in due form of Law by the affidavit of Levi Diamond and of the subscribing witnesses thereto - which said will is hereto annexed marked A and under which your Petitioner is appointed sole Executrix.
          That

 

no probate or letters of administration has as yet been granted to said Estate.
          Your Petitioner therefore prays that probate to the said will may be granted to her
          And as in duty bound will ever pray.

In the name of God, Amen. The twenty second day of June one thousand eight hundred and eighty four.
Henry Heath of St. John's, Boot and shoemaker, being of sound mind but being sick and weak of body, do give and bequeath unto my wife Nancy Barnes during her natural life, my farm on the Portugal Cove Road, dwelling house in the City of St. John's (during lease thereof), household furniture and moneys remaining after my burial expenses are paid: yet at the same time I would recommend her to sell or lease the above named farm.
I also bequeath to my beloved son Henry Thomas my good will and stock in trade in the shoe making business.
And I further bequeath on the demise of dear wife and unto my beloved children Margaret Sarah, Henry Thomas and George Alfred, all my real estate and moneys if any, household furniture and residue of term of Dwelling House.
I also appoint my said Wife Executrix of this my last Will and Testament.
In witness whereof I have hereunto set my hand and seal this day and year above written.

SUPREME COURT OF NEWFOUNDLAND

St. John's }
TO WIT   } Levi Diamond of St. John's aforesaid, Master Mariner, maketh oath and saith that on the 22nd day of June A.D. one thousand eight hundred and eighty four at St. Johns', he this Deponent, was present and did see Henry Heath late of St. John's, Shoemaker, the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Thomas Bearns and F. J. Doyle, the other subscribing witnesses thereto. That Deponent and said Thomas Bearns & F. J. Doyle then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
