Be it Remembered, That on this 31st day of May in the Forty-ninth Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-six personally appeared Agnes Eustace of Torbay in the Central District, Widow, William Martin of St. John's in the Central District, Grocer, and John Codner of same place, Fisherman, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Four hundred Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Agnes Eustace as Administratrix of the Estate and Effects of John Eustace late of Torbay, Fisherman, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Agnes Eustace as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 31st day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Agnes Eustace or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 31st day of May which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

To Wit          } I do swear that I believe that John James Eustace, late of Torbay, Fisherman, deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two hundred dollars.

To the Honourable the Supreme Court
or one of the Honourable the Judges
thereof.

The Petition of the undersigned Agnes J. Eustace, widow of the late John Eustace of Torbay.

Humbly Sheweth

          That the late John Eustis (sic), the husband of petitioner died some *two four months since, intestate.
That he left him surviving his widow (your petitioner) who is now with child by said deceased.
That said intestate carried on business in Torbay as a partner with his three brothers.
That James Eustis(sic), Father of said intestate died about **four three years ago having first, as petitioner is informed and verily believes, made and published his last will and testament.
That said will is in possession of Thomas Eustis, Eldest son of said James Eustis, or in the possession of some of his brothers and has not been proved as petitioner is informed and verily believes.
That about a year ago, after the death of the said James Eustis, his brother Richard Eustis died having first made and published his last will and Testament which is now, as petitioner is informed and verily believes in the possession of the Revd Msr Heggate.
That no steps have been taken so far as petitioner can learn to obtain probate to said will.
Petitioner verily believes that under the provisions of both said wills, her late husband was entitled to one fourth interest in a large amount of property now held by the brothers of her late husband.
Petitioner has no means of estimating the value of her late husbands interest in the property of said James and Richard Eustis or of his interest in the copartnership business with his said brothers.
Letters of administration to petitioners husbands estate have not been granted or heretofore applied for by her but a notice that administration to his Estate would be applied for by Thomas Eustis was posted in the office of the Chief Clerk and Registrar of this Honourable Court, a caveat was entered and no further steps taken by said Thomas Eustis.
Petitioner prays First that administration to her late husbands Estate may be granted to her.
Second - That the said Thomas Eustis or such persons as may have in their possession the will of the said James Eustis may be ordered to produce and bring into Court said will that such steps may be taken as the Court may direct.
Third - That the Revd Msr Heggate or such other person as may have the will of the late Richard Eustis in possession may be ordered to produce and bring into Court said will that such steps may be taken in relation thereto as the Court may direct.
And as in duty bound your petitioner will ever pray.
