To Wit }
I do swear that I believe that John Diamond, late of Adams Cove in the Northern District, Planter, deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four thousand five hundred dollars.

Be it Remembered, That on this Ninth day of October in the Forty 50th Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-six personally appeared Thomas Diamond of Adams Cove in the Northern District of Newfoundland, Planter, James J. Rogerson of St. John's in the Central District, Merchant and John Steer of St. John's aforesaid, Merchant and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Nine thousand Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:--
NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Thomas Diamond as Administrator of the Estate and Effects of John Diamond late of Adams Cove, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Thomas Diamond as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the Ninth day of April next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Thomas Diamond or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the Ninth day of October which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Knight of St. John's aforesaid, Gentleman, Student-at-law-, maketh oath and saith that in or about the month of November of last year the ordinary three days notice of administration in this case was posted up in the office of the Chief Clerk and Registrar where it remained for three days and for a considerable time thereafter and that no caveat was entered thereto, that the same has since been lost or mislaid and cannot now be found.

The Petition of Thomas Diamond of Adams
Cove, Conception Bay, Planter,
Humbly Sheweth
That Petitioners' father, John Diamond died intestate in the month of April of this present year leaving him surviving his widow Martha, two sons Peter and Petitioner, and four daughters, Jane married to William Moores, Helen Married to Cyrus King, Selina married to Hugh Legrow and Miriam who is unmarried.
That the said John Diamond at the time of his decease was possessed of the sum of Five Hundred and twenty five pounds in Bank deposit receipts.
That besides the said deposit receipts, deceased was possessed of a Dwelling House, fishing property and about two or three acres of land situate at Adams Cove aforesaid.
That the whole estate of the said John Diamond does not exceed Four Thousand Dollars.
That no Probate or Administration to the said Estate has been granted or applied for.
Petitioner therefore prays that Administration to the Estate of said deceased may be granted to him.
And as in duty bound he will ever pray &c

Carbonear } Henry Lewis of Blackhead, Methodist Minister, maketh oath and saith that he was personally present and did see Martha Diamond, Peter Diamond, Jane Moores, William Moores, Hugh LeGrow and Miriam Diamond severally sign their names and affix their marks to the paper writing or consent hereto annexed as the same appear to be signed or affixed and that the same was read and explained to each of the said parties as signed by affixing their marks.
