To Wit          } I do swear that I believe that Edward Cullen, late of St. John's in the Central District of Newfoundland, Baker, deceased died with a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Three Thousand and Two Hundred dollars.

Notice

Three days after date, application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for Letters of Administration cum testamento annexo to the Estate and effects of Edward Cullen, late of Saint John's, Newfoundland, Baker, to be granted to Ann Cullen, wife of Deceased.
Dated at Saint John's this sixth day of February Anno Domini 1886.

The Petition of Ann Cullen of Saint John's, Widow of the late Edward Cellen

Humbly Sheweth

  1. That Edward Cullen, husband of the petitioner and Baker died at Saint John's on the first day of February Anno Domini One Thousand Eight Hundred and Eighty Six leaving him surviving Ann Cullen his wife, and three daughters Ellen, Margaret and Mary Ann Cullen.
  2. That the said Edward Cullen previous to his death made and published his last Will and Testament which is hereto annexed and proof of which was duly made upon oath.
  3. That there is no Executor named or appointed by the said Will for the execution of the same.
  4. That the said Estate and Effects of said Edward Cullen consist of landed and personal property of an aggregate value of about thirty-two hundred /$3200.00/.
  5. That no administration to said estate has been granted or prayed for.

 

Prayer

Your petitioner therefore prays that letters of Administration cum testamento annexo be granted to her to enable all the legatees under said last will and Testament to receive their respective shares and to enable her to distribute the same according to the instructions in such last will and Testament expressed
          And as in Duty bound your petitioner will ever pray

TO WIT       }

          John O'Dwyer of St. John's aforesaid, Publican, maketh oath and saith that on the thirty first day of January A.D. one thousand eight hundred and eighty six at St. John's he, this Deponent, was present and did see Edward Cullen, late of same place, the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Thomas J. Murphy the other subscribing witness thereto. That Deponent and said Thomas J. Murphy then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other - That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said Thomas J. Murphy and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

This is the last Will and Testament of me, Edward Cullen, of St. John's in the Island of Newfoundland, Baker.
First. I will that all my just debts, funeral and testamentary expenses be paid by my beloved wife.
Second. I devise and bequeath the sum of five hundred pounds currency now in the Savings Bank of Newfoundland equally among my wife and three daughters, Ellen, Margaret and Mary Ann to have, hold and enjoy, free from their, my daughters husbands control and I will that my daughter Mary Ann is to receive her sum of one hundred and twenty five pounds only in such portions and at such times as my wife thinks well of giving it to her.
Third. Out of the remaining money in the Newfoundland Savings Bank I give ten pounds to the Roman Catholic Orphanage Belvidere.
Fourth. I devise and bequeath the house on the corner of Duckworth and Cochrane Streets to my daughter, she paying the ground rent thereof and taking my wife to live with her and giving her a room therein and after my wife's death, then Margaret to have all my right, title and interest in said house.
Fifth. The rent of the factory now held of me by ??????? (Mr. Oke) as tenant, I give and devise to my wife together with all other property herein undisposed of.

Be it Remembered, That on this Fifteenth day of February in the Forty-ninth Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-six personally appeared Ann Cullen of Saint John's Widow, Charles Kickham of same place Architect and John Dwyer of same place Grocer and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of six thousand four hundred Dollars, to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Ann Cullen as Administratrix of the Estate and Effects of Edward Cullen late of Saint John's Baker, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her, the said Ann Cullen as such Administrator or to the hands or possession of any other person, or persons for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the fifteenth day of August next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Ann Cullen or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the fifteenth day of February which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
