AFFIDAVIT

You shall swear that you believe this to be the true last Will and Testament of James Brennan late of St. John's in the Central District of Newfoundland, Dealer, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said James Brennan deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Five Thousand Five Hundred Dollars.

To the Honorable The Supreme Court
of Newfoundland or any one of the
Honorable The Judges thereof.

The petition of The Very Reverend John Ryan of St. John's, Roman Catholic Priest and of Michael Tobin of same place, Merchant,

Humbly Sheweth

That James Brennan late of St. John's aforesaid, Dealer, died there on or about the first day of September now present, having first made as executors to his last Will and Testament as hereto annexed and which will has been duly proven in Common Form.
That said deceased left him surviving as his next of kin one daughter Mary, now a professed nun, and resident in Albany in the United States of America and one brother and two sisters -- and died possessed of property situate within the jurisdiction of this honorable Court of the probable value of about five thousand dollars.
That no probate or administration to the estate of the said deceased has been hitherto granted.
That in and by his said last Will and Testament he nominated and appointed your Petitioners as Executors thereof.
          Petitioners therefore pray that probate of the said Will may be granted unto them and as in duty bound they will ever pray &c &c &c.
Dated at St. John's this tenth day of September A.D. 1886

NOTICE

After three days from the date hereof, application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate of the Will of Letters of Administration of the Estate and effects of James Brennan, formerly of St. John's, Dealer, deceased to be granted to Revd John Ryan and Michael Tobin Executors named in said will.
          Dated at St. John's this 7th day of September Anno Domini 1886.

          I hereby certify that the notice on the other side hereof written has been posted in my office from the day of the date thereof to this date and that no caveat or other objection thereto has been filed or entered.

SUPREME COURT OF NEWFOUNDLAND

TO WIT       }

          James D. Ryan of St. John's, Dealer, maketh oath and saith that on the 26th day of August A.D. one thousand eight hundred and eighty six at St. John' s he, this Deponent was present and did see James Brennan late of St. John's aforesaid, the Testator named in the paper writing hereto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Bridget Tobin of St. John's, wife of Michael Tobin, the other subscribing witness thereto. That Deponent and said Bridget Tobin then signed their names to such will as such witnesses in the presence of the said Testator and of each other - That previously to the said Will being so signed as aforesaid by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said Bridget Tobin and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponents knowledge and belief.

In the name of God, Amen.
          I, James Brennan of St. John's in the island of Newfoundland, Dealer, do make, publish and declare the following as and for my last Will and Testament.
First. I will and direct that all my just debts and funeral and testamentary (page torn - expenses) shall be paid by my executors herein named.
Second. I will and bequeath to my daughter Mary Brennan the sum of Fifty Pounds Currency to pay for her board in the Convent, and a further sum of three hundred pounds currency.
Third. I will and bequeath the sum of Thirty pounds Cy. for Masses for the repose of my soul.
Fourth. I will and bequeath to my brother Edward Brennan my house and land on Topsail Road at present occupied by my said brother Edward during his natural life.
Fifth. I will and bequeath my house on Patrick Street at present occupied by Mr. Ledingham for the use of the orphanage at Villa Nova near Topsail.
Sixth. I will and bequeath my house on Patrick Street at present occupied by Mrs. M. O'Flanagan to my sister Mary Fitzgibbons.
Seventh. I will and bequeath to the Rev. John Ryan, St. Patricks River Head, St. John's, the sum of ten pounds.
In the Fifth clause, I make the following alteration ~ namely, the rent ?????? (page torn) House on Patrick Street bequeathed to (page torn) the orphanage at Villa Nova is for a period of six years to be devoted towards education my nephew Patrick, son of my brother Edward.
Eighth. All the rest, residue and remainder of my lands, moneys, chattels and effects, I will and bequeath to my sister Mary Fitzgibbons aforesaid for her sole and separate use, behoof and benefit.
I do hereby revoke and declare null and void all former and other wills by me made and do hereby nominate and appoint the Rev. John Ryan, St. Patricks and Michael Tobin, Merchant, Executors of this my last Will and Testament.
Dated at St. John's this 26th day of August A.D. 1886.
