NOTICE

Three days after date, application will be made to the Supreme Court or one of the Judges of the said Court for Letters of Probate to the Will of the late Alexander W. Bermmer of Trinity, Newfoundland, Merchant, to be granted to the Executrix and Executor named in his will.

Robert Laurie of St. John's, Draper, maketh oath and saith that on the 16th day of March A.D. one thousand eight hundred and eighty five at St. John's, London, England he, this Deponent, was present and did see Alexander W. Bremmer late of Trinity, Merchant, the testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Henry Hall of London aforesaid, Merchant, the other subscribing witness thereto. That Deponent and said Henry Hall then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

          I, Alexander Warren Bremmer of Trinity and St. John's in the Island of Newfoundland, make and publish this my last Will and Testament, hereby revoking all former Wills. And for the due performance and Execution of this, I hereby appoint my wife Executrix and my sons Robert Sweetland, and Alexander Hugh my Executors.

1st. I wish and direct that the sum of Ten Thousand Pounds (£10,000) curncy of Newf'land (currency of Newfoundland) being part of the balance now due to me by Walter Grieve and Company of St. John's, Newf'land, be invested in the mercantile trade or business, to be continued and carried on in Trinity, Newf'land in connexion with the said Walter Grieve & Co for five years from the end of the year 1884, according to the terms of the deal of Co-partnership which said business is to be terminated at the end of the year one thousand eight hundred and eighty nine so far as my interest, and my Estate are concerned, and the realized capital divided and paid as hereafter provided, it being arranged with my son Robert S. that he is to have one half of my share of the net profits of the Trinity Trade of "Walter Grieve & Bremmer" during the time he is manager thereof, and I direct that such said portion of my share of the profits, be reserved to be paid to him from my Estate, before payment of the residuary moneys named in Article (5) Fifth.

2nd. I desire and direct that all other moneys and effects (except House and lands hereafter devised) belonging to my Estate at my death, be realized, and invested in Government or other good security affirmed of by my Executrix and Executors, and the interest on all be paid annually to my wife, for maintenance of herself and our children until the end of the year 1889, as soon after which as possible, there shall be paid from the general funds of my estate, the following legacies, vizt
To my sisters Isabel and Annie, two hundred and fifty pounds (£250) currency each.
To my wife for her own sole use, four thousand pounds currency (£4,000).
To my wife in trust for her maintenance during life, and the maintenance of our unmarried daughters, four thousand pounds (£4,000) cuny - the interest annually for maintenance - and the capital to be divided equally at her death between our surviving children and there(sic) deceased leaving issue, the issue of any deceased having the share of the deceased parent.
To my sons Robert Sweetland and Alexander Hugh, and to my daughters "Helen Maria Isobel", Marian, and "Ethel Grace" - one thousand five hundred pounds Cy (£1,500) each - the bequest for Alexander Hugh to be in trust and care of his mother until he attains the age of twenty one years.

3rd. I give and devise to my wife for her use and the use of our unmarried daughters during her, and their lives, the leasehold Dwelling House in Cathedral Street, St. John's, Nfd and the furniture therein - at her and their death, the house and furniture to be realized and divided equally between our children, the issue of any deceased to have between them, the share of their deceased parent.

4th. I give and devise to my sons Robert S. and Alexander Hugh, in equal shares, all my right and interest in landed property and premises in Catalina.

5th. I give and bequeath all residuary moneys and other effects of my estate, to my wife and our children, or the issue of any deceased child, said issue (if any) to have the share of the deceased parent - to be divided and paid them as soon as possible after the final realization of my estate in 1890, or as any remaining portion may be realized thereafter (if so long delayed) in the following proportions, vizt.
One fourth each to my sons Robert S. and Alexander H., and the remaining two fourths to be equally divided between my wife and our three daughters, or those surviving, but the share of any deceased child to be divided between his or her issue, if any. - Dated and signed in duplicate at London this Sixteenth day of March A.D. 1885.

          The petition of Robert Sweetland Bremmer, at present in St. John's, Merchant,

Sheweth

          That Alexander Warren Bremmer late of Trinity and St. John's in Newfoundland, Merchant, departed this life on or about the second third day of October last, having previously made his last Will and Testament hereto annexed marked A of which he appointed your Petitioner and his brother Alexander Hugh and his widow Tryphena E. S. Executors and Executrix.
          That the said Alexander Warren Bremmer left him survifing his said Widow and two sons, also three daughters, Helen Maria Isobel, Marian and Ethel Grace.
          That at the time of his decease, the said Alexander Warren Bremmmer was possessed of property in this Island in the value not exceeding, in the opinion of your Petitioner and to the best of his knowledge and belief, the sum of one hundred and twenty thousand dollars.
          Your Petitioner prays that Letters of Probate to the Will of the said deceased may be granted to your Petitioner's said mother Tryphena E. S. Bremmer and to your Petitioner and his said brother the Executrix and Executors in the said Will named and appointed.
          And as in duty bound will ever pray.

Brenner, late of Trinity, the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Gilbert D. Shears the other subscribing witness thereto. That Deponent and said Gilbert D. (You shall) swear that you believe this to be the true last Will and Testament of Alexander Warren Bremmer late of Trinity in the Northern District, Merchant, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that (the whole of) the Goods, Rights, Chattels, Assets, Credits and Effects of the said Alexander W. Bremmer deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of one hundred and twenty thousand Dollars.

So Help you God.
