After Three days application will be made to the Honourable the Supreme Court or one of the Honourable The judges thereof for probate of the will of the late John Tobin of Saint Johns Licensed dealer deceased to be granted to Mary Tobin widow of said deceased Executrix named Therein ---

The petition of Mary Tobin of Saint Johns widow and PatrickMurphy of same place farmer

Humbly Sheweth

That John Tobin of Saint Johns aforesaid licensed Dealer died on the seventeenth day of June in the present year having first made his last will and testament which is hereto annexed proved upon the oath of John Toole one of the subscribing witnesses to the same

That under the said will your petitioners were appoin-ted Executrix and Executor respectively

That at the time of his death deceased was possessed of property of the probable value of Nine hundred dollars.

That neither probate to any will nor administration to the Estate and Effects has as yet been granted to any one

Your petitioners Therefore pray that probate of the said annexed last will and testament of the said John Tobin may be granted to them and as in duty bound they will Ever pray

ST. JOHN'S   }                              SUPREME COURT OF NEWFOUNDLAND.
TO WIT         }
John Toole of Saint Johns aforesaid maketh oath and saith that on the 28th day of January A.D. one thousand eight hundred and eighty Three at Saint Johns ------------------ he, this Deponent, was present and did see John Tobin ------------- late of Saint Johns the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of P. J. Scott. The other subscribing witness thereto. That Deponent and said P.J. Scott then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other---That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it is read over to, and approved of by the said Testator in the presence of Deponent and the said P.J. Scott. and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

          In the name of God Amen -----
I, John Tobin of St John's Licensed Dealer do make and ordain this as and for my last will and testament. After the payment of my just debts funeral and testamentary expenses I give devise and bequeath to my beloved wife Mary all the Estate Monies goods chattels and effects of which I shall die possessed or entitled to same a sum of fifty five pounds which I give and bequeath to my beloved sister Elizabeth wife of Patrick Murphy of St John's aforesaid Carter. I will and direct that out of the bequest to my said beloved wife fifteen pounds shall be devoted for High and Low Masses for the repose of my Soul, and that out of the fifty five pounds bequeathed to my sister aforesaid she shall devote five pounds for Masses for the Sons of our deceased father and Mother, the late Patrick Tobin and the late Catherine Tobin; I appoint my beloved wife Executrix and the said Patrick Murphy Executor of this my last Will and testament.

To Wit.           } We do swear that we believe that John Tobin late of St John's in the Central District licensed dealer deceased died with a Will; and that we will well and truly administer all and every the Goods of the said deceased and pay his debts so far as his Goods will extend; and that we will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of our Administration into the Registry of the said Court within six months from the date hereof, or when we shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of our knowledge, judgment and be-lief, amount to the value of Nine hundred and fifty dollars
