A F F I D A V I T .

You shall swear that you believe this to be the true last Will and Testament of James Rolls late of Saint Johns in the Central District Merchant deceased --------------------------------------------------------------------------------------------------------
You shall swear that you will pay all the Debts and Legacies of the deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inven-tory of all and every the Goods, Rights and Credits of the deceased, together with a just and true ac-count into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called hereto; And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said James Rolls -------------------------------------------------------------------------------------------- deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of Fifteen Thousand five hundred ----------------------- dollars

So help you God.

St Johns to wit     } Henry Lemessurier of Saint Johns aforesaid Commissioner Merchant maketh oath and saith that he is one of the Executors nominated and appointed by the will of Said deceased. That deponent has not intermeddled in any way in the Estate of Said deceased. That deponent is desirous of renouncing and does hereby renounce his said office of Executor

This is the Last Will and Testament of me James Rolls of Saint Johns, and formerly of Shireminister(?) Newton England
I revoke all former Wills and testaments heretofore made by me. I bequeath the whole of my estate real and personal and wheresoever situate (after payment of my just debts and funeral and testamentary expenses) to my dear wife Lucretia Rolls to have hold occupy pos-sess and enjoy the same and the rents issues profits and income arising therefrom for the term of her natural life. Upon the death of my said wife Iwill and devise that the whole of my said estate shall go to my sons James John and William my daughter Amelia (wife of Henry Earle) and Susannah, wife of Thomas S. Pook(?) and my granddaughter Eliza Herbert, daughter of Horace and Eliza Herbert absolutely in Equal shares and proportions as tenants in common the share so bequeathed to my said daughters and granddaughter to be for their and each of their sole and sepa-rate use and free from the Control of any husband. It is further my desire and request that in the event of my said wife not requiring for her own main-tenance and support the whole of the rents profits and income arising out of my said Estate the surplus or balance

not so required shall be applied to the liquidation of the mortgage upon the Mount Dorset property to Mr. Thomas Bennet (now deceased) In the Event of the death of any of the said lega-tees (other than my said wife) before my death I desire that the share or interest bequeathed to him or her shall go to his or her representatives. I appoint my said Son James and Henry Lemesse -rier of S Johns Merchant Executors of this my last Will.

SUPREME COURT OF NEWFOUNDLAND.

TO WIT    }
James S. Winter ------------------------------------ of Saint John's Barrister at Law maketh oath and saith that on the fourteenth day of December A.D. one thousand eight hundred and eighty two at Saint John's aforesaid he, the Deponent, was present and did see James Rolls --------------------- late of Saint Johns merchant the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Thomas Ryan of St John's Storekeeper the other subscribing witness thereto. That Deponent and said Thomas Ryan-------------------------- then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other ------------------------------------------------------------------------------------------- and that at the time of the said execution of the said Will the said Testator was of sound mind, memory and understanding, to the best of Deponent's knowledge and belief.

To the Honourable the Supreme Court, or one of the Judges thereof

The Petition of Henry LeMesserier of St Johns Merchant, and James Rolls of Barr'd Islands at present of S Johns Merchant

Humbly Sheweth

That James Rollslte of St John's Merchant died at that place on the third day of January last

That said deceased before his death made and executed a last Will and Testa-ment which is hereto annexed, and whereof he appointed your Petitioners Executors, That the said Henry Le Messurier has renounced his said office of Executor

That said deceased at the time of his death was possessed of property within the jurisdiction of this Honourable Court of the probable value of fifteen thousand dollars.

Petitioners therefore pray that Probate of the said Will may be granted to these twothe said James Rolls the remaining Executors as aforesaid, And as in duty bound they will Ever pray &c
