A F F I D A V I T.

You shall swear that you believe this to be the true last Will and Testament of Robert Pitman late of Lamaline in the Southern District Trader deceased

You shall swear that you will pay all the Debts and Legacies of the deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inven-tory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account, into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto; And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Robert Pitman deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of Twenty & two Hundred ------------------dollars

So help you God.

After three days application will be made to the Honourable the Supreme Court of Newfoundland or to one of the Honourable the Judges thereof for Probate of the will of Robert Pitman late of Lamaline Trader deceased to be granted to Eleanor Pitman widow of deceased Sole Executrix named in Said will

TO WIT                      }                 SUPEME COURT OF NEWFOUNDLAND.
I, Edgar Kelland, Police Constable of Lamaline maketh oath and saith that on the Twenty Second day of July A.D. one thousand eight hundred and eighty two at Lamaline he, this Deponent, was present and did see Robert PitmanTrader late of Lamaline the Testator named in the paper writing hereunto annexed duly sign, (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of John Hillier the other subscribing witness thereto. That Deponent and said John Hillier then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other---That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of Deponent and the said John Hillier and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

In the Name of God Amen.
I Robert Pitman Trader of Lamaline being Sound in mind but weak in body do hereby make this my last Will and Testament Viz
I will and bequeath unto my well beloved Son George Robert the Sum of one hundred pounds with interest, and to my well beloved daughter Emily the Sum of Fifty pounds with interest, both Sums at present in the Union Bank and to my well beloved daughter Mary Ellen the Sum of Sixty pounds with interest deposited in the Savings Bank in June 1882. And the sum of Fifty pounds, deposited in the Savings Bank in 1881 with interest to my well beloved wife Eleanor All outstanding debts and the money in the House to go for the Support of my wife and children.
The Small Meadow Situate to west of our old House on the meadow my half of it to be equally divided between my well beloved daughters Mary Ellen and Emily. The House and the property Furniture &c to my well beloved wife and Provided She does not alter her name, if She does, to my Son George Robert, and all the rest of my property to my Wife and Children While She retains my name, but if changed to my children equally.
And I hereby appoint my well beloved Wife Eleanor Sole Executrix of this my last Will and Testament

The Petition of Eleanor Pitman of Lamaline Widow

Humbly Sheweth

That Robert Pitman late of Lamaline Trader husband of Petitioner died there on or about the twenty second day of July AD 1883 having previously made and Executed his last Will and Testament which is hereto annexed and of which he appointed your petitioner Sole Executor
That Said deceased was at the time of his death possessed of property of the probable value of Twenty one Hundred dollars -
That no Probate of any will of Said deceased has been granted to any person

          Petitioner therefore prays that Probate of the said will of Said deceased may be granted to her
          And petitioner as in duty bound will Ever pray &c
          Dated at Lamaline this 10th day of October AD 1885
