You shall swear that you believe this to be the true last Will and Testament of John Patterson of Saint Johns Master mariner deceased ------------------------------

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Patterson ----------- deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Three Thousand ------------------------------------------------------ Dollars

So help you GOD.

The Petition of Mary Patterson of St. Johns Widow

Humbly Sheweth

That John Patterson formerly of St Johns aforesaid Master Mariner died there on or about the fifth day of November last past - having first made and executed his last will and testament as hereto annexed.
That the said will has been duly proved in common form (?). That said deceased died possessed of property situate within the Jurisdiction of this Honorable Court of the probable value of about Two thou-sand eight hundred dollars and left him surviving Petitioner who is his widow and three sons namely Thomas whose perma-nent place of residence is out of this Colony Patrick who is married and residing in this Colony and William a minor residing with your petitioner as his next of kin. That no probate or administra-tion to the Estate of the said deceased has been hitherto granted. That in and by his said last will and testament he nominated and appointed your petitioner as Executrix
thereof

Petitioner therefore prays that probate of the said will may be granted unto her and as in duty bound she will ever pray &c, &c, &c.

SUPREME COURT OF NEWFOUNDLAND.

TO WIT      }
Joseph I Little of St. Johns a Judge of the Supreme Court maketh oath and saith that on the second day of September A.D. one thousand eight hundred and eightyseventy at St John's aforesaid --------- he, this Deponent, was present and did see John Patterson late of St. John's Master Mariner the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed writing as and for his last Will and Testament, in the presence of this Deponent and of N.P. Kitchin the other subscribing witness thereto. That Deponent and said N.P. Kitchin then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I John Patterson of St John's Master Mariner do make and declare this to be my last will and testament. First I give devise and bequeath all and every my monies goods Chattels and effects of what nature & kind soever they may be to my wife Mary Patterson for her sole and separate use ---- behoof and Benefit. Secondly I do hereby nominate and appoint my said wife sole executrix of this my will.          Dated at S. John's Newfoundland this second day of September Anno Domini One thousand eight hundred and seventy.
