To the Honourable the Supreme Court or one of the Honourable the Judges thereof The Petition of Thomas Murphy of Saint Johns Road Inspector Humbly Sheweth That Moses Neil late of Freshwater near St. John's Farmer died there in or about August AD 1884. That Said John Carew having Since died your petitioner is Sole Surviving Executor of said Will. That Said Moses Neil at the time of his death was possessed of property of the probable value of Two thousand dollars. That no Probate of said will has as yet been granted to any persons Petitioner therefore prays that Probate of Said Will be granted to him. And as in duty bound will Ever pray &c.

This is the last will and testament of me Moses Neil of Freshwater Farmer Page 2 from any other party or parties for and during her lifetime and after her death I will that the said farm property goods and chattels are to pass over into the possession of my son William Neil. I also will that my very(?) Said beloved wife Bridget do not in any way sell mortgate encumber or dispose of the said real or personal property or any portion thereof during her said lifetime And I expressly forbid my son William Neil from selling mortgaging encumbering or disposing or leasing the said property after he comes into its possession. Page 3 Signed published and declared by the said Moses Neil as his last will and testament in our presence who in his presence and in the presence of each other have subscribed our hands as witnesses it having been first carefully read over and Explained. ST. JOHN'S } Thomas Murphy of Saint Johns Road Inspector maketh oath and saith that on the 28th day of September A.D. one thousand eight hundred and eighty three at Freshwater near Saint Johns he, this Deponent, was present and did see Moses Neil late of Freshwater aforesaid the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of John Carew of Saint Johns aforesaid Undertaker deceased the other subscribing witness thereto. That Deponent and said John Carew then signed their names to such Will as such witne-sses, in the presence of the said Testator and of each other---That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and apporoved of by the said Testator in the presence of Deponent and the said John Carew and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
