AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Daniel Murphy late of Bay de Verde in the Northern District Planter deceased -----------------------------------------------------------------------------------------------------------------------------------------------
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Daniel Murphy deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Six hundred and fifty -------------------------------------- Dollars

So help you GOD.

          In the name of God Amen.
This is the last Will and Testement of me Daniel Murphy Bay De Verde, Conception Bay, District of Bay De Verde Merchant.
I give, devise and bequeath all my real and personal estate of every description unto my Wife Anastia Murphy absolutely.
I appoint my said Wife sole executrix of This my Will and revoke all previouswills at any time made by me
After the death of my Wife Anastia Murphy, I bequeath to my Nephew James Murphy of Patrick the above mentioned property in whole and in part. But in case my Wife Anastia Murphy should at any time consent to give up her right in The aforesaid property She is entitled to by con---?of the ---------? Therein invested to receive from my Nephew James Murphy a sum of One hundred pounds currency. I also give to the said James Murphy an equal share in The business & (?) Trade with my Wife Anastia Murphy, as long as the said James Murphy thinks expedient to continue partnership with the said Anastia Murphy. For Witness whereof, Thereunto set my hand this Seventh day of December in the year of our Lord one Thousand eight hundred and eighty two.                              Daniel Murphy

Michael Harty------------------------------- of Northern District Catholic Clergyman maketh oath and saith that on the Seventh day of December A.D. one thousand eight hundred and Seventy Eighty two at Bay de Verde he this Deponent was present and did see Daniel Murphy late of Bay de Verde Merchant the Testator named in the paper writing hereto annexed, duly sign ----------------------------------- publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of William North Jnr(?) the other subscribing witness thereto. That Deponent and said William North Jnr then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Humbly Sheweth

          That your Petitioners Husband Daniel Murphy late of Bay de Verd Planter deceased died at that place in the month of December AD 1882 having first made and Executed as and for his last will and testament the paper writing hereto annexed marked 'A'
          That the Said will has been duly proven
          That your Petitioner is appointed Sole Executrix under the Said Will
          That deceased at the time of his death was possessed of property of the probable value of Six Hundred Dollars
          That no probate or Administration has been granted to the Estate
