AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Thomas Manuel late of Twillingate in the Northern District of Newfoundland - Planter - deceased -

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Thomas Manuel deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Six Hundred and fifty Dollars

So help you GOD.

          This is the last Will and Testament of Thomas Manuel late of Twillingate in the Northern District in the Island of Newfoundland now of Loon Bay District and Island(?) aforesaid/Planter
I give devise and bequeath to my Son Thomas James Manuel, my Messuage or Dwelling House in which I now reside, Household - furniture and Effects - Land and premises there unto belonging situate in Loon Bay aforesaid
I give and bequeath to my Sons - Titus Manuel and Obadiah Manuel each Ten pounds current money of Newfoundland To be paid to each on my Youngest Daughter Lydia Manuel Jane Manuel now residing with the - attaining the age of Twenty One Years - and further I give and bequeath to my Daughter Sarah Matilda the Wife of Thomas Guy - Amelia Ann the Wife of Frederick Slade - Joanna Clara the Wife of Francis Forward and Lydia Jane Manuel aforementioned - the sum of Ten pounds Currency to be paid to each; on her The said Lydia Jane Manuel attaining the age aforementioned, for their own Sole use and benefit and that the same shall not be subject to their Husbands Debt or Control and that their receipt alone not withstanding Their Coverture shall be a good and sufficient discharge for The same - All the rest and residue of my property, personal and real I give devise and bequeath to my Son Thomas James Manuel for his own absolute use, and benefit

to wit          } in the Northern District of Newfoundland - Assayer of Weights and Measures - maketh oath and saith that on the Thirty First day of May one thousand Eight hundred and Seventy five at Twillingate aforesaid he this Deponent was present and did see Thomas Manuel late of Twillingate aforesaid - Planter the Testator named in the paper writing hereunto annexed marked          duly sign publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and John Peyton the other subscribing Witness thereto - That Deponent and said John Peyton then and there signed their names to such will as such Witnesses in the presence of said Testator and of each other - and that at the time of the Execution of said Will the said Testator was of sound and disposing mind memory and understanding to the best

Twillingate -

The Petition of Thomas James Manuel and Thomas Peyton of Twillingate.

Humbly Sheweth

          That Thomas Manuel late of Twillingate in the Northern District of Newfoundland Planter - deceased died at Loon Bay Harbor in the Northern District on or about the winter of Eighteen hundred and Eighty one leaving him surviving no widow - but Three Sons and three Daughters -
          That the said Thomas Manuel left a will which is hereunto annexed and which has been proven in due form of law by the affidavit of James Payton one of the subscribing Witnesses thereto - which said proof of will is also hereunto annexed - That at the time of the decease of the said Thomas Manuel he had a fixed place of abode namely

at Loon Bay aforesaid within the jurisdiction of the Court - that at the time of the death of the said Thomas Manuel he was possessed of property of the value of about Six Hundred Dollars -
          That no probate or Administration has as yet been taken out to the said Estate of Said Thomas Manuel deceased -
          Your Petitioner Therefore prays That Probate to The said Will may be granted to your Petitioners and as in duty bound they will Ever pray -
