You shall swear that you believe this to be the true last Will and Testament of Jeffery Lash late of Paignton Devon England Gentleman (heretofore of St John's, Newfoundland deceased -------- You shall swear that you will pay all the Debts and Legacies of the deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account, into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and effects of the said Jeffery Lash ------------------------------------- deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of fifteen thousand five hundred dollars

the life tenant Marianne Lash Mch. 20. 1904.

ASSETS

All that land and premises situate on Water Street St. John's bounded on the South by Water Street by which it extends 54 feet On the East by Murphy & Sons by which it extends 234(?) feet on the West by Holdsworth Street by which it extends 170 feet and on the north by Georges Street by which it extends 56 feet Held under lease from Estate of Holdsworth expiring October 30th 1910 subject to annual rent of $980.00.

All that land and premises on the South side of Water Street st. John's extending thereby 25 feet on the East by Premises leased to O'Dwyer & MacKintosh and extending thereby 55 feet on the South by the said premises 14 feet and by premises of Messrs Terrier, and on the West by land leased to John Moore Haskell and extend-ing thereby 45 feet and by a way 8 feet wide with the use of the said way and a right of ingress and egress thro the premises of O'Dwyer & MacKintosh held under lease expiring 31st. October 1911 at rental of 150.00 per annum.

An interest in Little Laws Mine Placentia Bay.

          We Augustus F. Goodridge and James Baird both of St. John's aforesaid merchants surviving Executors of the will of Jeffrey Lash deceased severally make oath and say as follows:-

  1. We have according to the best of our knowledge, information and belief set forth in the account hereto annexed marked I a full inventory of thee joint estates of the said Jeffrey & George lash at the death of Marianne Lash the life tenant.
  2. We have according to the best of our knowledge, information and belief set forth in the account hereto annexed markd II and the rent rolls therein referred to, a full statement of the proceeds of the said Estates which came to our hands or to the hands of any person by our order with the times when due to the said Estates, the names of the persons from whom and on what ac-count the same have been received, and alsoa like statement of the disburse-ments, allowances, and payments made by us on account of the said estates to-gether with particulars as to the parties and purposes for which the same were disbursed allowed or paid.
  3. And we each speaking positively for himself and to the bestof his knowledge and belief as to other persons, further say that except as appears in said accounts we have not nor has any of us nor has any person by our order or the order of any of us, of for our use or for the use of any of us possessed received or get in any rents or profits of the said estates nor any money in respect thereof.

  1. To the best of my knowledge information and belief and as far as I can at present ascertain this account hereto annexed marked I set forth thereto as inventory therein of all the Estate of the said George Lash at the death of Marianne Lash the life tenant.
  2. I have examined the account marked II and the rent rolls therein refer-red to, and to the best of my knowledge information and belief the receipts and disbursements therein set out were so received and disbursed.
  3.           I James J. McGrath of St. John's aforesaid, Solicitor, make oath and say:-

  1. The firm of Whiteway & McGrath of which I am a partner are Agents for the Executors (Hon Jas. Baird and A.F. Goodridge) and the administrator (Donald M. Browning) in the management of the said Estates.
  2. The accounts I, II, III marked with the letter A, produced and shown to me at the swearing of this my affidavit and purporting to the accounts of the said Executors and Administrators with the Estates of Jeffrey and George Lash, deceased, from the 7th. December 1905 until the 20th. August 1906, contain a true account of all and every sum of money received by the said Executors and Administrator or by any other person or persons by their or any of their orderor orders or by the said firm
  3. The several sums of money mentioned in the said accounts hereby verified to have been paid and disbursed have been actually and truly so paid and disbursed in the manner in the said accounts mentioned.
  4. The said accounts are just and true in all and every of the items and particulars therein contained according to the best of my knowledge and belief.

Humbly Sheweth

          That Jeffrey Lash heretofore of St. John's aforesaid but lately of Paignton aforesaid died at Paignton aforesaid on or about the sixteenth day of February last having previously made and pub-lished his last will and testament hereunto annexed by which will he appointed your petitioners executors and executrix thereof;
          That the estate of the said Jeffrey Lash at the time of his decease was almost entirely within the jurisdiction of the said Court and did not exceed the sum of fifteen thousand dollars in value
          That no probate of the said will or administration of the said estate have been granted.
          That your petitioners have ob-tained proof of the said will in the form hereto annexed.
          Your petitioners therefore humbly pray that letters of probate of the said last will and testament of the said

Whereas Jeffery Lash formerly of St. John's in the Island of Newfoundland but lately of Paignton England gentleman died on or about the sixteenth day of February last (1885) having pre-viously made and published his last will and testament and a codicil thereto by which will he appointed me Marianne Lash executrix and Augustus F. Goodridge and James Baird senior both of St John's aforesaid executor of said will And Whereas the estate of the said testator is in Newfoundland for which reason it is necessary that probate of the said will be taken in the Supreme Court of Newfoundland Now Know All Men by these presents that I the said Marianne Lash executrix as afore-said have made ordained authorized constituted and appointed and by those presents Do make ordain authorize constitute and appoint Sir William Vallance Whiteway K.C.M.G. of St. John's aforesaid Barrister at law my true and lawful attorney for me and in my name to apply to the said Supreme Court for letters of probate of the said will and codicil to be granted to me as executrix and to the said Augustus

Goodridge and James Baird senior executors as aforesaid and for that purpose to sign all necessary pe-titions or papers and to do all manner of things necessary to procure the admission of the said will to probate before the said Supreme Court of New-foundland and to obtain the grant of letters of probate as aforesaid and for my said attorney or any substitute to be by him appointed under his hand and seal to sign seal and execute all deeds or paper writings and to do all matters and things whatsoever for me and in my name as executrix aforesaid which may after the grant of such probate by necessary in con-nection with the said estate whether for leasing property part thereof contracting for sale and perfecting con-veyance of any part of said property or otherwise as to my said attorney shall seem meet or for collecting any rents interest or dividends and if ne-cessary suing for the same provided that in the doing or execution of any deed act matter or thing under the terms of the last clause hereof that is to say from the words "and for my said attorney or any substitute" to the words "shall seem meet" my said attorney shall not act except the executors be parties with my

This is the Last Will and Testament of me Jeffery Lash formerly of Saint John's Newfoundland Merchant but now residing at Avalon Villa Paignton in the county of Devon Gentleman I appoint my Sister-in-law Marianne Lash to be Executrix and my Cousin Augustus Frederick Goodridge of Saint Johns Newfoundland and my friend James Baird Senior also of Saint Johns Newfoundland to be Executors of this my Will and I appoint the said Augustus Frederick Goodridge and James Baird hereinafter called "my Trustees" to be Trustees of this my Will I direct all my just debts funeral and testamentary expenses and also the legacies bequeathed by this my Will or any Codicil hereto to be paid off and discharged as soon as conveniently may be after my decease- I give devise and bequeath unto my sister Catherine Goodridge Caldwell widow of the late James Caldwell residing in Melbourne Australia the sum of Two hundred pounds absolutely but should my said sister die before my decease I give devise and bequeath the same unto her daughter absolutely I give devise and bequeath unto my sister Mary Grace Haddow the wife of William Haddow residing at Chelston terrace Torquay in the said county of Devon the sum of Two hundred pounds absolutely and should this my said sister die before my decease I give devise and bequeath the same unto Mary Louisa Haddow Catherine Grace Roberts wife of the late Ogelvie Roberts Margaret Ann Haddow and Emma Caroline Haddow daughter of my said sister Mary Grace Haddow in

equal shares as tenants in common I give (devise) and bequeath unto my niece Agnes Goodridge Farrell the sum of Fifty pounds absolutely I give devise and bequeath unto John Lash son of my brother Frederick Lash one hundred pounds absolutely I give devise and bequeath unto my niece Grace Lash sister of the above named John Lash Fifty pounds absolutely and I give devise and bequeath unto "my Trustees" the sum of Twenty five pounds each as some recognition for their services and the trouble they will be put to in the execution of the trusts of this my Will and I direct and it is my wish that the above mentioned Legacies and debts be paid and discharged out of my Bank shares which I have in the Commercial Bank Newfoundland and the shares which I have in the Steam Fry? Company in Newfoundland All the rest residue and remainder of my Estate both real and personal of whatever kind and wheresoever situate I give devise and bequeath unto "my Trustees" Upon trust to pay the annual income thereof to my said sister-in-law Marianne Lash during her life and from and after her decease In trust for her four sons Jeffery Frederick - Mortimer George - George Richard Page and William Herbert - or any child or children of such of her said four sons who may die in her lifetime the objects of this trust to take in equal shares as tenants in common and not as joint tenants except that the child or children of any deceased son of the said Marianne Lash shall take the above only which his her or their parent would have

taken if he had survived his mother the said Marianne Lash And it is my wish that if "my Trustees" find it necessary to employ an Agent or Attorney to collect the rents and dividends of any of my property in Newfoundland or generally to manage the same that they do employ Sir William Vallance Whiteway of Saint Johns Newfoundland (who has for sometime past faithfully and conscientiously performed the duties of Agent and Attorney for me) their agent or attorney And hereby revoking all former Wills at anytime heretofore made by me I declare this to be my last Will and ---- Testament In witness whereof I have hereunto set my hand the second day of February one thousand eight hundred and eighty five -
