AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Bridget Kirwin late of Saint John's in the Central District Widow deceased------------------------------------------------------------------------------------------------------------------------------------------------
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And, you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Bridget Kirwin ------------------ deceased, and of which she died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Two Thousand ------------------------------------------------------------ Dollars

The Petition of Thomas Shortal of St John's Gentleman

Humbly Sheweth

That Bridget Kirwen late of St John's aforesaidWidow departed this life in the year One thousand Eight hundred and Seventy Seven having previously Made her last Will and Testament which is hereto annexed and which has been duly proved wherein she appointed Charles Reilly of the Cockpit Road and Your Petitioner Executors of her said Will
That the said Bridget Kirwen was at the time of her death possessed of property of the probable value of Two thousand dollars
That the said Charles Reilly died about three years ago.
That no Probate to the said Will or Administration to the said Estate has been taken out or applied for
Your Petitioner therefore prays that Probate of the said Will he granted to him And as in duty bound he will Ever pray

This is the last Will and testament of Bridget Kirwin of Saint John's West

I hereby give, devise and bequeath to my two grand-sons Denis and Bartholemew Walsh and to my grand-daughter Catherine Walsh, wife to John Connors, all that piece and parcel of land situate on the South Side of the Bay-Bulls road and bounded on the South by the River, on the West by Public road leading to Said river on the North by the Bay-Bulls road and on the East by land belonging to the R.C. Church, in the occupancy of Martin Casey to be divided between them into equal portions with this proviso, that the Eastern portion is to be the property of the aforesaid Catherine Walsh, to belong to them and their heirs absolutely and forever
I also give, devise and bequeath the dwelling house situate on the aforesaid piece of land to my aforesaid grand-sons and grand-daughter, the Northern, or Parlour, End with the furniture contained therein and free access thereto to my grand-daughter, Catherine Walsh the Southern, or Kitchin, End to be the property of My aforesaid grand-Sons in common.

________________Thomas Shortal____________ of Saint John's Newfoundland Gentleman maketh oath and saith that on the Sixteenth day of June A.D. one thousand eight hundred and eightyseventy seven at Saint John's aforesaid he, this Deponent, was present and did see Bridget Kirwen_________ late of Saint John's aforesaid the Testatrix named in the paper writing hereunto annexed duly sign (by making her mark) publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of Charles Rielly -------------------------------------------------------------------------------------------------------------------------------------------------------------- the other subscribing witness thereto. That Deponent and said Charles Rielly ------------------------------------------------------------------------------------------------------- then signed their names to such Will as such witnesses, in the presence of the said TeStatrix and of each other --- That previously to the said Will being so signed as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by the said Testatrix in the presence of Deponent and the said ---------Charles Rielly ------------------------------------------------------------------------------- and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
