Hynes by filing in theoffice of the Clerk of the Supreme Court on circuit at Little Bay Registrars office and serving on the said Andrew C. Hynes or his Proctor an answer containing the grounds on which she resists such grant on or before the 19th day of

Supreme Court of Newfoundland Be it Remembered, That on this Twenty sixth day of November in the Forty ninth -------Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Eighty five personally appeared Andrew C. Hynes of Little Bay Islands Planter, John Martin of St John's Civil Engineer and George Luscombe also of St John's Cooper and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal sum of Two hundred ----------------------------------------------------------------------------- Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following: NOW THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above bounden Andrew C Hynes------------ as Administrator of the Estate and Effects of James Hewlett -------------------------------------- late of Sunday Cove Island in the Northern District Fisherman deceased, do make, or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, pos-session, or knowledge of him the said Andrew C. Hynes as such Administrator or to the hands or possession of any other person or persons for him shall well and truly administer, according to Law, and further shall make, or cause to be made, a just and true account of his said Admnistration, on or before the 26th day of November which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty six and afterwards from time to time as he -------------- shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration acc'ount, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force virtue. The Honourable the Supreme The petition of Andrew C. Hynes of Little Bay Islands in the Northern District Planter Humbly Sheweth That James Hewlett late of Sunday Cove Island in the Northern District fisherman deceased died in or about the month of April Anno Domini eighteen hundred and Eighty two intestate leaving him surviving his widow and several children under the age of twenty one years That at the time of the deceased of the said James Hewlett he was possessed of a House and premises at Sunday Cove Island aforesaid also some fishing gear as deponent is informed and believes That from deponents information he is unable correctly to estimate the value of the said Estate but believes the same does not exceed one hundred and twenty dollars in value. That at the time of the decease of the said James Hewlett he was and his estate still is indebted to this petitioner in Page 2 the sum of sixty Eight dollars and upwards for goods sold and delivered by this peti-tioner to the said James Hewlett at his request That the said said Estate and a portion of goods supplied by this petitioner was and still are in the possession of the said widow That no letters of administration of the said estate have been granted That application has been made by this petitioner for payment of the said debt but no payment has been yet made Your petitioner therefore humbly prays that the said widow of the said James Hewlett and all other persons if any who shall be found entitled to a citation be cited before your Honourable Court on a day in such citation to be named to shew cause why letters of administration of the said estate of James Hewlett deceased should not be granted to your petitioner Your petitioner also prays that such letters of administration be granted to him or to some other person in order that your petitioner may recover the said debt due him and that such order be made in the premises as may be deemed just
