AFFIDAVIT.

          You shall swear that you believe this to be the true last Will and Testament of George Gibson Geddes late of Saint Johns in the Central District of Newfoundland Storekeeper deceased. ----------------------------------------------------------------------------------------------------

You shall swear that you will pay all the Debts and Legacies of the deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full, and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account, into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said George Gibson Geddes deceased, and of which he died pos-sessed, do not according to the best of your knowledge, judgment and belief, amount to the value of Five thousand --------------------------------------------------------------------- dollars

So help you GOD.

Hayward of St. John's aforesaid Queen's Counsel - maketh oath and saith that on the Twenty ninth day of April A.D. one thousand eight hundred and eighty five at St. John's aforesaid he this Deponent was present and did see George Gibson Geddes late of St. John's aforesaid the Testator named in the paper writing hereto annexed duly sign publish and declare The said annexed paper writing as and for his last will and Testament in the presence of this Deponent and of Arthur Clift the other subscribing Witness thereto
That said Deponent and said Arthur Clift ThEn and There signed their names to such Will as suchWitnesses in the presence of the said Testator and of Each other - and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind memory and understanding - to the best of Deponent's knowledge and belief ---

The Petition of Robert Thorburn of St. John's - Merchant -

Humbly Sheweth

          That George Gibson Geddes late of St. John's Store-keeper died at St. John's on or about the ninth instant leaving him surviving one Daughter only viz. Mary Elizabeth O'Mara - That the said deceased left a Will which is hereunto annexed and which has been duly proven by the Affidavit of August O. Hayward one of the subscribing Witnesses thereto - which said proof is also hereto annexed
          That the said George Gibson Geddes at the time of his decease left monies and property of the probable value of Four Thousand Dollars - That no Probate as Administ-trator has as yet been taken out to his Estate -
          That in and under said Will your Petitioner was appointed Sole Executor - and Therefore prays that Probate to said will may be granted to him and as in duty bound he will Ever pray -

First - I give devise and bequeath to Timothy Cummins of St. John's - Clerk in the Examining Goods office St. John's - The sum of Fifty Dollars -

Second - I give devise and bequeath to Robert Laurie of St. John's - Buyer(?) at Messrs Walter Greene & Coes The sum of Twenty Dollars -

Third - I give devise and bequeath to Mrs Betsey Kelly wife of John Kelly of Middle Cove - near St. John's - the sum of Twenty Dollars ---

Fourth - I give devise and bequeath to Robert Thorburn of St. John's Merchant - The sum of Thirty Dollars to purchase a plain Gold Ring as a Souvenir of our long friendship -

Fifth - I give devise and bequeath to my Daughter Mary Elizabeth O'Mara - Widow of The late David W. O'Mara - of Ferryland in the Southern District of Newfoundland - in yearly Instalments of Two Hundred Dollars - all The residue
and

and remainder of my Estate of every description and kind whatsoever including a piece of Land on the North Side of The Penneywell Road - St. John's - Also a Life Policy in the Masonic Mutual Insurance Company of Newfoundland also any other monies chattels or effects that I may be possessed of at the time of my death - The first payment to be made Twelve Months after my decease - all of which is to be free from the control of any future Husband - and with power only to the said Mary Elizabeth O'Mara to will the same to the children she had by the late David W. O'Mara - share and share alike - and further That she shall have no power whatever under this Will to leave any portion of the said Estate to any future Husband she may have - nor to any child that she may have by him.

Sixth - I hereby cancel the bequest made by me in a former Will to my Daughter in Law - Martha A. Weldon(?) of Moncton New Brunswick - and I hereby revoke all former Will or Wills made by me - and declare this to be my last Will and Testament -

          Lastly - I appoint The
