AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of George Filmore of Saint Johns Master Mariner

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said George Filmore deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Ten thousand --------------------------- Dollars

So help you GOD.

The Petition of Augustus Frederick Goodridge of Saint John's merchant

Humbly Sheweth

That George Filmore late of Saint Johns master mariner died there on or about the latter part day of December last having previously made and Executed his last Will and Testament which is hereto annexed of which he appointed your petitioner Sole Executor
That said deceased at the time of his death was possessed of property of the probable value of eightten thousand four hundred dollars
That no Probate of any Will or Administration of the Estate of Said deceased has been granted to any person
Petitioner therefore prays that Probate of the Said Will may be granted to him according to law. And as in duty bound he will Ever pray &c

          The last Will and Testament of George Filmore Master Mariner of St John's Newfoundland
First I Give and Bequeath to my Daughter Sarah wife of Revd Robert Bramfitt The Sum of one Hundred Pounds Cy to be paid in cash out of money belonging to me in the Commercial Bank for her Sole use and Benefitt free from the controle of her husband
Secondly I Give and Bequeath To My Daughter Jessie Elizabeth Filmore all my House hold Furniture Beds and Bedding Pictures and Pianoes watches and Chains and clock and all my wearing apparel likewise my Interest in the lease of the Shop and house now Occupied by Me Like wise all money in The house and in The Savings Bank in my name after Paying My Sickness and Funeral Expences out of The Same If the Said Jessie Elizabeth wishes to continue The Business I likewise Bequeath her all The Stock in trade and Interest accrueing from Money that will be laying in The com Bank after Paying Sarah her Hundred Pounds out of it I likewise Empower My Executors To Give The Said Jessie the Sum of Fifty Pounds out of the commercial Bank if necessary To replenish The Stock in The Shop If The Said Jessie do not wish to continue The Business The Stock is to be Sold and The Proceeds added To The Money in The commercial Bank and My Executors To Pay her Forty Pounds Cy Per Year out of The Said money (The afore Said Interest

If The Said Jessie Elizabeth Marries And wish To Keep on The Business it is To be hers for her Sole use and Benefitt Clear of free from the crontroll of Her Husband if She Marries and do not Keep on The Business The Stock in Trade To be Sold and added To The Money in the Commercial Bank and The whole of Said Money To be Divided Equally between My Two Daughters Jessie Elisabeth and Sarah --- likewise if Jessie Marries and Keeps on the Business The Money in The commercial bank to be DividedEqually Between My Two Daughters aforesail
In case of The Demise of My Daughter Sarah before The Division of The Money in the comm Bank it is My wish That her Share of Said Money will be Equally Divided among her Children

TO WIT        }                                        SUPREME COURT OF NEWFOUNDLAND.

Donald Morison of Saint Johns Barrister-at-Law maketh oath and saith that on the Sixteenth day of December A. D. one thousand eight hundred and eighty four at Saint John's aforesaid he, this Deponent, was present and did see George Filmore late of Saint John's Master Mariner the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Sarah Westcott and Jessie Filmore the other subscribing witnesses thereto. That Deponent and said Sarah Westcott and Jessie Filmore then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other---That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said Sarah Westcott and Jessie Filmore and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
