To the honourable Francis Brady Chief Justice And The Honourable the Assistant Judges of the Honourable The Supreme Court

The Petition of Thomas Finn and William Taylor of Richard of Carbonear Newfoundland Planters

Humbly Sheweth

That John Howell of William late of Carbonear, Planter departed this life at Carbonear in the year 1850 making no will but leaving was surviving his daughters only. That is Mary Frances aged about 42 years married to Thomas Fynn your Lordships Petitioner and Harriet married to William Taylor of Richard also your Lordships Petitioner, aged about 37 years. That the deceased left land and property in Carbonear of the probably value of Two hundred pounds or there about.That ??? the use of Administration in order that the same may be disposed of according to law; your Petitioners therefore humbly pray that your lordships will be pleased to commit the Administration of the Intestate Estate of the late John Howell to your Petitioners and who as in duty bound will ever pray,

Be it Remembered, That on this Twentieth day of February in the Seventeenth Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of our Lord One Thousand Eight Hundred and Fifty four personally appeared Thomas Finn and William Taylor of Richard of Carbonear, Petitioners and John Ryan of Harbor Grace, Shipowner and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of Four hundred Pounds of good and lawful Money of Great Britain, to be had, made, and levied on their Goods, Chattels, and Effects, jointly and severally, if Default is made in any of the Conditions following:

Now the Condition of this Obligation is such, That if the above boundens Thomas Finn and William Taylor of Richard as Administrators of the Estate and Effects of John Howell of William late of Carbonear, Planter deceased, do make, or cause to be made, a just, true and perfect inventory of all and singular the Goods, Credits, and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of them the said Thomas Finn and William Taylor of Richard as such Administrators or to the hands or possession of any other person or persons, for them and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the Twentieth day of August next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits, and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of them the said Thomas Finn and William Taylor of Richard or to the hands or possession of any other person or persons for them shall well and truly Administer according to Law, and further shall make, or cause to made, a just and true Account of their said Administration, on or before the Twentieth day of February which will be in the Year of our Lord One Thousand Eight Hundred and Fifty five and afterwards from time to time as they shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits, and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct; then this Obligation to be void and no effect, or else to be and remain in full force and virtue.

TO WIT.

We do swear that we believe John Howell of William late of Carbonear, Planter deceased, died without a Will; and that we will well and truly Administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that we will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of our Administration into the Registry of the said Court, within Twelve months from the date hereof, or when we shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said deceased, which he died possess of, within the jurisdiction of this Court, do not, according to the best of our knowledge, judgment, and belief, amount to the value of Two hundred Pounds sterling.
