Last Will and Testament of
William Dyer of Logy Bay
Planter deceased.

      This is the last will and Testament of me William Dyer of Logy Bay in the Island of Newfoundland fisherman.

First. I give devise and bequeath unto my sons Richard Dyer and Daniel Dyer and my Grandson William Dyer (son of Richard Dyer) and my Grandson William Dyer (son of late son William Dyer) all that piece of land situate on the north side of Logy Bay road aforesaid as follows:

  • To the first named the lot marked No 1 and the land running in a straight line from the number to the river.
  • To the second the lot marked No 2 and running in the same direction:
  • To the third the lot marked No 3 and running the same direction.
  • To the fourth the lot marked No 4 and running in the same direction.

Secondly. I give devise and bequeath unto my sons Daniel and Richard Dwyer share and share alike all the fishing room, and the property and belongings in and around the same and all the fishing appurtenances therein or thereto.

Thirdly I give and devise and bequeath unto my son Walter all that piece of land with dwelling house thereon and all appurtenances thereto which he now occupies absolutely.

Fourthly. I give devise and bequeath unto my Grandson William son of my late son Michael all that piece of land and dwelling house which my said late son Michael formerly occupied absolutely.

Fifthly I give devise and bequeath all that piece of land with dwelling house and appurtenances thereunto belonging (with exception of a small portion hereinafter mentioned situate on the Outer Cove Road where I formerly lived unto my son Daniel until my son James who is now resident in the United States of America returns. And in the event of his not returning for or in ten years from the date of my death the said land (with the exception hereinafter mentioned) and dwelling and appurtenances shall remain the property of my said son Daniel and his assigns

Sixthly. I give devise and bequeath unto my son Patrick Dyer a piece of land being a portion of the last mentioned and fenced off from same, and mentioned in the last paragraph as the exception, and his assigns.

Seventhly. The above bequests of the several lots of land owned by me, to my several sons and Grandson are subject to the following provisions viz: that none of the above mentioned legatees shall at any time dispose of by sale, or rent, or lease or mortgage except with one another, the said several pieces and lots of land and dwelling houses and in the event of any of the legatees above mentioned doing contrary to what is herein contained shall be sufficient authority to the remaining legatees to claim his said portion and divide or have the same divided between them share and share alike.

Eighthly. I appoint John W. White of St. John's Solicitor executor of this my last will and testament. And I hereby revoke all former wills which by me may have been made. In testimony whereof I have hereto subscribed my hand by affixing my mark this 20th day of June (at St. John's aforesaid) A.D. 1896. (Sgd) William his x mark Dyer. Signed by the said Testator (by affixing his mark) in our presence who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses (the same having been first read over and explained to the said testator) (sgd) John Burke auctioneer.
