Last Will and Testament of
Peter Dwyer of Harbor Grace
Merchant deceased.
To all to whom these presents shall come Greeting.
I Peter Dwyer of Harbor Grace Merchant, being of sound disposing mind memory
and understanding do make publish and declare this to be my last will and testament
(1) I give devise and bequeath all my property at Long Island Labrador, consisting
of three fishing rooms, boats, nets and fishing gear unto my brothers in law
Michael Kehoe and Thomas Dalton my nephew John
Duggan and my nieces Mary Joseph
Holden and Anastatia Hanrahan in four shares one quarter share each to the
three first named one quarter share to the last two named. The salt stored
in one of the said rooms is owned by John Munn & Co and is to be delivered
to their agent.
(2) I give devise and bequeath unto my wife Bridget Dwyer the sum of Thirty
four hundred dollars, my watch and all my household furniture.
(3) I give devise and bequeath unto my son Richard Dwyer the sum of Twenty
four hundred dollars together with eight hundred dollars together with eight
hundred dollars in the Harbor Grace water company stock.
(4) I give devise and bequeath to my sister Ellen Kehoe the sum of Thirteen
hundred and forty dollars and a further sum of Two hundred dollars being one
fourth of the Compensation money received by me for lands taken from my Father's
property for Railway purposes and a further sum of sixty dollars being one
fourth of the Insurance money received by me for my Fathers house destroyed
by fire after deducting premiums paid by me.
(5) I give devise and bequeath to my sister Mary Dalton Thirteen hundred and
forty dollars and a further sum of Two hundred dollars being one fourth of
the Compensation money received by me for land taken from my fathers property
for Railway purposes and a further sum of sixty dollars being one fourth of
the Insurance money received by me for my fathers house destroyed by fire after
deducting premiums paid by me.
(6) I give devise and bequeath to my nephew John Duggan Seven hundred and forty
dollars and a further sum of Two hundred dollars being one fourth of the compensation
money received by me for land taken from my fathers property for Railway purposes
and a further sum of sixty dollars being one fourth of the Insurance money
received by me for my fathers house destroyed by fire after deducting premiums
paid by me.
(7) I give devise and bequeath unto my niece Mary Joseph Holden the sum of
six hundred and seventy dollars and also my shop and store situate at Harbor
Main and a further sum of one hundred dollars being one eight of the compensation
money received by me for land taken from my fathers property for Railway purposes
and a further sum of Thirty dollars being one eight of the Insurance money
received for my fathers house destroyed by fire after deducting premiums paid
by me
(8) I give devise and bequeath unto my niece Anastasia Hanrahan the sum of
eight hundred and seventy dollars and a further sum of one hundred dollars
being one eight of the compensation money received by me for land taken from
my fathers property for Railway purposes and a further sum of thirty dollars
being one eight of the Insurance money received for my fathers house destroyed
by fire, after deducting premiums paid by me
(9) I give devise and bequeath unto my grand nephew Leo Dwyer Holden the sum
of Four hundred dollars
(10) I give devise and bequeath unto my grand niece Gertrude Holden the sum
of four hundred dollars
(11) I give devise and bequeath unto my grand nephew Joseph Hanrahan the sum
of four hundred dollars.
(12) I give devise and bequeath unto my grand nephew Thomas Hanrahan the sum
of Two hundred dollars.
(13) I give devise and bequeath unto my niece Bridget Kehoe the sum of Four
hundred dollars
(14) I give devise and bequeath unto my niece Mary Dalton the sum of Four hundred
dollars.
(15) I give devise and bequeath unto my niece Anastasia Dalton the sum of two
hundred dollars
(16) I give devise and bequeath unto my niece Alice Dalton the sum of two hundred
dollars.
(17) I give devise and bequeath unto my niece Ann Kehoe the sum of two hundred
dollars
(18) I give devise and bequeath unto the Most Reverend A. Macdonald Bishop
of Harbor Grace the following sums namely one hundred dollars for the Cathedral
Fund, one hundred dollars for the Church of Riverhead Harbor Grace. One thousand
dollars for masses for the repose of my soul.
(19) I give devise and bequeath the sum of two hundred and forty dollars for
masses for the souls of my parents, sisters and brothers deceased to be apportioned
as follows to the Rev John March ninety dollars to the
Rev. Michael Stanley Fifty dollars to the Rev John Roe fifty dollars and to the Rev.
Felix D. McCarthy fifty dollars.
(20) I give devise and bequeath unto the Presentation Convent at Harbor Grace
the sum of fifty dollars.
(21) I give devise and bequeath to my Executors hereinafter named a sum not
exceeding four hundred and forty dollars to defray my funeral expenses and
to purchase a suitable monument to be erected beside my grave and further that
a sum not exceeding four hundred dollars be expended to purchase a wall tablet
to my memory and that of my parents, brother and sisters said tablet to be
placed (with the Bishops permission) in the church at Riverhead. Should said
tablet not cost four hundred dollars the balance is to go to the said Bishop
for said church.
(22) Also I give and bequeath unto all my legatees hereinbefore mentioned except
the Bishop the Priests the Convent, the interest arising on the properly mortgaged
to me by certain parties in Harbor Grace. Said interest to be divided among
the said legatees proportionally And when said mortgage shall have been paid
off the amounts received shall also be divided among such legatees in proportion
to the amount of each legacy.
(23) Also I give and bequeath the residue of my money if any to my son Richard
Dwyer.
(24) It is my will that all monetary bequests herein before expressed except
those to my wife Bridget Dwyer and my son Richard
Dwyer the Bishop the Priests
and the Convent and the debts due by me and the amounts to defray my funeral
expenses and for the monument, be left in the Bank for the period of ten years
from the date of my death, giving to each legatee only the power of drawing
the interest and twenty pounds or eighty dollars of the principal of his or
her bequest for each and every year during the above mentioned period of ten
years.
(25) It is my will also that should any of my legatees make or cause any trouble
in my family with reference to the changes that my fathers estate has undergone
during my possession of it, then and in that case the bequest or bequests herein
made to such party shall be cancelled by my executors hereinafter named.
(26) With reference to my duty as executor of my sister Ann's estate I hereby
entrust the management of said estate to his Lordship Bishop Macdonald requesting
him to carry out the intentions of my sister as expressed in her last will
and Testament.
Lastly I appoint my son Richard Dwyer and my nephew
in law Thomas Hanrahan executors to this my last will and Testament and I revoke
all previous wills by me at any time heretofore made. In witness whereof I
have hereunto set and subscribed my hand and seal at Harbor Grace aforesaid
this twenty fifth day of October A.D. 1892. (Sgd) Peter Dwyer (LS) Signed and
