Will of Patrick Dunphy
from Newfoundland will books volume 8 pages 248 to 250 probate year 1907

In re
      Patrick Dunphy          deceased.

      In the name of God Amen    This is the last will and Testament of me Patrick Dunphy of North East Placentia District of Placentia and St. Mary’s Planter. I appoint Thomas Whelan of Jersey Side Placentia executor of this my last will and Testament.

1. I will that my just debts be paid as soon as possible after my decease

2nd. I will the sum of Fifty Dollars for Masses for the repose of my soul to be celebrated in two years from my death as my executor shall decide.

3rd. I will devise and bequeath the sum of Twenty Five Dollars yearly to be paid my Father and Mother, this bequest to cease after eight years- the whole amount is not to exceed two hundred dollars, and at their death the money is to go to my wife.

4th The balance of my property both real and personal consisting of Cash in the Bank of Montreal and Life Assurance with the Consideration Life also all my property situate at the north East consisting of house, two stores, half of two stages flakes (situated on my Fathers land) cattle and goods of every description (with the exception of my share of wharf) I will devise and bequeath to my wife and family my wife is to have full control whilst she remains unmarried but in the event of her marrying again she is to forfeit all claim to my estate and all is to be divided amongst my children    I will that the money in the Bank is to be reserved for the support of my wife and family and to that end only as little as possible is to drawn yearly

5th I will my share of the wharf to my father

6th I will that my wife can sell all property situated at the north East should she so desire and the proceeds to go to herself and family. Should my Father or Mother object to such sale the yearly allowance to them aforesaid shall cease.

7th At my wife death or marriage all the property I will to my children    In witness whereof I have hereunto subscribed my hand at North East Placentia this 21st day of December A.D. one thousand nine Hundred and six    Patrick Dunphy. Signed by the Testator Patrick Dunphy and acknowledged by him to be his last will and Testament in the presence of us who in his presence and in the presence of each other at the same time and at his request have hereunto subscribed our names as witnesses Thomas Whelan
