Will of Elizabeth Dunphy from Newfoundland will books volume 14 page 319 probate year 1928

In re       DECEASED.
      ELIZABETH DUNPHY.

This is the last will and testament of me, Elizabeth Dunphy of St. John's Newfoundland, widow, and I revoke all former wills by me made. I hereby appoint and nominate my daughter Theresa sole executrix of this my will.

  1. After payment of all my debts funeral testamentary and otherwise my executrix is to convert into cash at the best prices obtainable all my estate of every description and wheresoever situate and out of the proceeds plus any cash on hand or in bank at the time of my death first pay herself the sum of one thousand dollars and if there should not be sufficient funds to pay the said one thousand dollars then she is to have all the proceeds plus any cash as aforesaid.
  2. I will and bequeath to my sister Mrs. Alice Hawley of No 345 Belbarn Road Birmingham England the sum of one hundred dollars provided there is a balance to pay same or a part thereof after payment of the said one thousand dollars firstly and the further payment of fifty dollars for Masses for the repose of my soul secondly and the payment of five hundred dollars to each of my children living at the time of my death including Theresa thirdly.
  3. The balance if any, after all the mentioned payments is to be divided equally between all my children living at the time of my death.
  4. If Theresa should predecease me then the children of mine living at the time of my death shall be substituted as legatees instead of Theresa in paragraph one aforesaid, the legatees to share equally.

In witness whereof I have hereunto subscribed my hand to this my last will at St. John's aforesaid this 13th day of January 1927.
