This name is spelled Roger in the will index, and Rodger
and Roger in the will.
Last will and Testament of
Rodger Down of St. John’s
Shoemaker deceased
This is the last will and Testament
of me Rodger Down of St. John’s in the Island of Newfoundland Shoemaker
hereby revoking all former wills and Testaments made by me.
First.
I give and bequeath to my son William Rodger the sum of six hundred dollars
to be paid out of my five per cent Government debentures And also all
my leasehold interest in the dwelling house and premises situate on the
North side of New Gower Street now held by one John Anderson as
my tenant And also all the household furniture held by me previous to
my second marriage and also my gold watch and chain.
Second I give and
bequeath to my daughter in law Marion wife of my said son William
Rodger the sum of Two hundred dollars to be paid out of my
four per cent Government debentures.
Third I give and bequeath to my
son Charles Samuel the sum of Four hundred dollars to be paid out of
my five per cent Government debentures And also all my interest in and
to that land and property with the tannery thereon situate near Rennie’s
Bridge, and in all the stock in trade tools implements and property belonging
to or connected with the said tannery and all debts due to me in connection
therewith
Fourth. I give and bequeath to my son Archibald the sum of
Three hundred dollars to be paid out of my four per cent government debentures
And also the western half of my double dwelling house on the North side
of the road leading from St. John’s to Mundy Pond Also the garden in front
of and appertaining to the said western half of said dwelling house.
Fifth.
I give and bequeath to my son Albert Chesley the sum of Three hundred
dollars to be paid out of my four per cent government debentures And
also the Eastern half of the said double dwelling house together with
the garden in front of and appertaining to the said eastern half and
the stable situate to the north east thereof And also all my land situate
to the rear or north of both halves of the said double dwelling house
and all my household furniture except that which is herein and otherwise
disposed of but if the said Albert Chesley shall die
without leaving issue everything bequeathed to him in this my will shall
go to my children then surviving share and share alike.
Sixth I give
and bequeath to my daughter Rose wife of William
Chancey to her sole
and separate use the sum of Four hundred dollars to be paid out of my
four per cent Government debentures.
Seventh. I give and bequeath to
my daughter Bessie wife of Thomas Curran to
her sole and separate use the sum of Three hundred dollars to be paid
out of my four per cent Government debentures.
Eighth
I give and bequeath to my daughter Selina wife of William
Motty to her
sole and separate use the sum of fifty dollars to be paid out of my four
per sent Government debentures and also my silver tea service.
Ninth
I give and bequeath to my sister in law Rose Hewardine Forty
dollars also the family sewing machine fitted with drawers which is now
in the house I occupy.
Tenth I give and bequeath all the residue of
my property to my sons Archibald and Albert
Chesley excepting the sum
of fifty dollars which I direct shall be paid my brother Robert out
of my four per cent Government debentures, but my Executor shall first
resort to such residue for the payment of my just debts funeral and Testamentary
expenses.
I appoint my said son William Rodger sole Executor
hereto.
St. John’s July 19th 1898 (sgd) Roger Down. Signed
published and declared by the said Testator as and for his last will
and Testament in our presence who in his presence and in the presence
of each other subscribe our names as witnesses hereto. (Sgd) Maria
Sexton.

Note from Geoff Martin: In the eighth clause, he mentions his daughter, Selina and her husband. Selina Tucker Down married William Henry MOTTY. They married in St. John's 29 Nov 1885.
