Last will and testament
of Bernard Dougherty
of St. John's Cabman Deceased
.

This is the last will and testament of me Bernard Dougherty of St. John's in the island of Newfoundland cabman. First I give devise and bequeath unto my daughter Ellen Dougherty the dwelling house I now live in together with the land thereto belonging running the width of the house to the rear boundary and together with all buildings and erections thereon to hold the same in her own right absolutely and forever. Second. I give devise and bequeath to my daughter Mary Hart all that land with dwelling house and other erections thereon belonging to me and situate to the westward of and adjoining the said dwelling house now in my occupancy to hold the same in her own right absolutely and forever provided nevertheless that so long as my daughter Ellen shall continue to use the horses and carriages as they are now used in the cab driving business. She shall have the use of the kitchen and stable as well as coach house as the same are now used in that business but should she discontinue that business then the buildings and erections in rear of house hereby bequeathed to Mary Hart and on the land belonging to that house shall forthwith be handed over to the possession of the said Mary Hart her executors administrators or assigns. Third I give devise and bequeath to my three children namely Hugh Dougherty and the said Mary Hart and Ellen Dougherty all that piece or parcel of land belonging to me situate on the Pennywell Road to hold the same in equal parts share and share alike. Fourth. After the payment of all my lawful debts as well as funeral and testamentary expenses I give devise and bequeath to my daughter Ellen before mentioned all the rest residue and remainder of my estate consisting chiefly of household furniture and effects and personal property of every description horses carriages and all and whatsoever money property and effects that I may die possessed of and wheresoever situate. Fifth I hereby appoint my son Hugh Dougherty of St. John's aforesaid to be the executor of this my last will and testament. In witness whereof I the said Bernard Dougherty have hereunto subscribed my hand at St. John's aforesaid this twenty fifth day of May in the year of our Lord one thousand eight hundred and ninety one Bernard his x mark Dougherty. Signed by the said testator as and for his last will and testament in the presence of us who being present at the same time and at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses first read over and explained J. Augustus Clift. Frederick W. Grant.
I certify the foregoing to be a correct copy of the last will and testament of Bernard Dougherty.
