Will of Mary Donnelly, from Newfoundland will books volume 15 pages 71 &72 probate year 1929

MARY DONNELLY

In the name of God

I Mary Donnelly of St. John's Spinster do make publish and declare this as and for my last will and testament. First, I hereby revoke anull and declare void all other and former wills made by me. Second. I hereby nominate and appoint my nephew Patrick J. Kent to be the Executor of this my will. Third. I will and direct that all my just debts funeral and Testamentary expenses be paid as soon as possible after my death. Fourth. I give and bequeath all my property goods and effects of every nature and kind of which I may die possessed or entitled to to my said executor in trust for my brother Right Revd Joseph V. Donnelly and my sister Catherine R. Donnelly or the survivor of them if they or either of them should survive me for life and upon the death of the survivor or if my said brother and sister should both predecease me to hold all my household furniture goods and effects in my house No 13 Monkstown Road in trust to transfer the same immediately to my niece Nellie Kent absolutely, and to hold all the rest of my said property goods and effects in trust for my said niece Nellie Kent for life, and after her death to hold my dwelling house shops and premises on the North side of Water Street in trust to receive the rents and and other income therefrom and after paying all taxes insurances rates repairs and other expenses to divide the balance yearly and every year unto four equal parts and to pay the said parts as follows:- one part to my said Nephew Patrick J. Kent, one part to my niece Marie J. Pennell of Boston Mass one part equally between my nieces Margaret and Madeline Donnelly of Montreal Canada or the survivor of them and the remaining one fourth part for masses for the repose of my soul and the souls of my father mother brothers and sisters nephews and nieces with power to my said executor to sell the said dwelling house shop and premises whenever in his discretion he may think is advisable to do so and to divide the proceeds of such sale into four equal parts and to pay the said parts in the same proportion amongst those to whom the income is payable as I have directed namely one fourth to my nephew Patrick J. Kent one fourth to my niece Marcie J. Pennell and one fourth equally between my nieces Margaret and Madeline Donnelly or the survivor of them and the remaining one fourth for masses as above stated, and after the death of my said niece Nellie Kent the hold the residue of my said property estate and effects in trust for my said nephew Patrick J. Kent absolutely subject to the bequest before stated of my said dwelling house shop and premises on Water Street. Lastly I wish my said niece Nellie Kent not to part with the grand fathers clock in my house No 13 Monkstown Road to any one but to a member of the family.

in our presence who in her presence and in the
presence of each other have hereto subscribed our hands
as witnesses this 18th day of May A.D. 1929 - the words
in my house No 13 Monkstown Road being first interlined
on page one hereof line 17.
