Last will and Testament
of John J. Dearin
of St. John's Druggist Deceased
.

In the name of God Amen. I John J. Dearin of St. John's Druggist do make publish and declare this as and for my last will and testament. First. I direct that all my just debts funeral and testamentary expenses shall be paid. Second. I will and direct that my executors hereinafter named shall as soon as conveniently can be after my decease invest in such securities as to them shall seem good and sufficient and with power from time to time to vary the same as to them shall seem proper a sum sufficient to produce an annual income of one hundred dollars and hold the sum so invested and the annual income thereof upon and subject to the trusts following - first: to pay and appropriate the said annual income at their discretion in each year towards the maintenance and support and education of my three grandchildren Frank, Monica and Mary Ann Dearin children of my deceased son John and of their mother, and of the survivor of them until the youngest of the said children shall have attained the age of twenty one years, and second, when the youngest of the said children shall have attained the age of twenty one years then upon trust to pay and divide the principal sum so invested as aforesaid in equal shares and proportions to and amongst the said children or the survivor of them and their said mother if she be then alive the children of any deceased child to have the parents share. Third Being aware that my daughter Catherine does not need money and desirous that she should possess something as a memento of me I give and bequeath to my said executors the sum of one hundred dollars to be by them expended in the purchase for her of such memento of me as they may think proper. Fourth. I give and bequeath to my son Albert all my right and interest in and to the house and premises in Water Street in which I now reside also all the household furniture goods and chattels therein including the two pianos. Also the stock in trade and all furniture pictures and fittings in my shop trade rooms and business premises, but should my said son decide to continue the trade and business there or elsewhere he shall allow to my grandson Frank now in the said shop a fair annual sum as wages and if my said son should decide not to continue the said trade and business then he shall realize and convert into money at the best obtainable prices the said stock in trade effects furniture fittings and fixtures and I give and bequeath to my said grandson Frank one third share of the nett proceeds thereof for his own use and benefit. Fifth. As regards my land and premises at Portugal Cove in Conception Bay I give and bequeath the same to my said son Albert with the express wish and desire that he should sell and dispose of the same at as early a time as possible. Sixth. I give and bequeath to my said executors the sum of $200.00 to be by them paid to the widow and son of my late brother George in such shares and proportions and at such times as to my said executors shall deem proper. Seventh. I will and direct that my said executors shall as soon as may be after my decease have one high mass celebrated for the repose of my soul and I give and bequeath to them the sum of eighty dollars to be appropriated for masses for the repose of my soul. Eighth. I will and direct that my executors shall invest in such securities as they may deem good and proper a sum sufficient to produce an annual income of twenty dollars and pay the said annual income to my housekeeper Mary now living with me during her lifetime and after her decease the money so invested shall be and form part of the residue of my estate and be disposed of as hereinafter directed in regard to such residue. Ninth. As regards the residue of my estate and effects I give and bequeath the same to my said son Albert. Tenth. I nominate and appoint my friends the honourable Mr. Justice Joseph I. Little and John Curran of St. John's aforesaid Clothier as executor of this my will and Lastly. I do hereby revoke annul and declare void all wills by me heretofore made. Witness my hand at St. John's this tenth day of June anno Domini one thousand eight hundred and ninety John J. Dearin Signed by the said John J. Dearin as and for his last will and testament in our presence and the presence of the testator at his request in his presence and the presence of each other have hereto set our hands as witnesses at St. John's on the day and year above written Thomas Horwood Robert J. Kent.
I John J. Dearin of St. John's Druggist do hereby make publish and declare this as a codicil to my within written will and testament. I revoke the sixth and seventh bequests within written in my said last will and I direct that my executors therein named shall pay and appropriate the sum of sixty dollars for masses for the repose of my soul including therein one high mass. I confirm my said will in every other particular. Witness my hand at St. John's this 10th day of June A.D. 1890 John J. Dearin Signed by the said testator as and for a codicil to his said last will in our presence on the day and year above written. Thomas Horwood Robert J. Kent.
I certify the foregoing to be a correct copy of the last will and testament of John J. Dearin.
