Will of Henry Dawe from Newfoundland will books volume 7 pages 200-201 probate year 1902

The last Will of
Henry Dawe late of Port de Grave
Merchant, deceased.

      This is the last will and Testament of me Henry Dawe of Port de Grave, Conception Bay, Merchant. I appoint my brother Samuel Dawe to be Executor.
(1). I give one hundred dollars ($100) to each of my brothers. Thomas Dawe and Samuel Dawe.
(2) I give to my beloved wife, Ann Maria Dawe, the residue of my property of every nature and kind whatsoever, save and except that portion which is made subject to the trusts following:
3. I give to my said executor in Trust the homestead in which I now live, the waterside premises which I now use, and all the land what I now own or possess for the following purposes:
(a) For the use of my said wife Ann Maria Dawe until her death or re-marriage, whichever shall first occur.
(b) Upon the death or re-marriage of my said wife, the "Hill Garden", so-called, is to become the property of my nephew, Robert Hartland Andrews absolutely, and the garden which I bought from Robert Taylor is to become the property of my brother Samuel Dawe absolutely.
( c) Upon the death or re-marriage of my said wife, the residue of the said Trust property is to become the property of my nephew George Dawe absolutely, if in the meantime he has not attempted to dispossess or otherwise interfere with the enjoyment by my said wife of the said property, but if he have so interfered, the said residue is become the property of John Dawe, son of my brother Samuel dawe.
Dated at St. John's this 16th day of November 1901. Henry Dawe. Witness: Signed by the above named Henry Dawe as his last will in the presence of us both being present at the same time, who in his presence and in the presence of each other have hereunto subscribed our names as witnesses.
