Will of Charles H. Danielle
from Newfoundland will books volume 7 pages 171-172 probate year 1902

The last Will of Charles H. Danielle
late of Irvine, Topsail Road, Hotel Proprietor
deceased.

      This is the last will and Testament of me Charles H. Danielle
1. I hereby appoint Frederick A. Brazil as executor of this my will.
2. I bequeath to Bertha Williams the sum of one hundred dollars ($100) if she be in my service at the time of my death.
3. I bequeath to Anastatia Ryan the sum of one hundred dollars ($100) if she be in my service at the time of my death.
4. I bequeath to Frederick A. Brazil if he be in my service at the time of my death the right to use my property known as Octagon Castle, to continue therein and thereon the business of a sienejuer resort and restaurant, inaugurated by me, for a period of 10 years from my death, after which date if he has so continuously used the said property, my whole right title and interest therein shall be his absolutely.
5. I bequeath all the rest, residue and remainder of my estate of every kind and nature whatsoever, to the said Frederick A. Brazil, provided he be in my service at the time of my death. Dated at St. John's the 27 day of May A.D. 1901 C.H. Danielle. Signed by the said Charles H. Danielle in our presence, who in his presence and in the presence of each other, sign our names hereto as witnesses, the day and year above written. H. B. Dwyer. Stewart Pike -

This is a codicil to my last will and testament. If from fire or other uncontrollable cause, for which the said Frederick A. Brazil is not responsible, the continuous operation of the Octagon as a summer resort and restaurant become impossible the discontinuance thereof shall not defeat my bequest of the said property to the said Frederick A. Brazil if within one year of the occurrence aforesaid he renew the operation on the site of the Octagon of a similar institution and continue it until the completion of the said period of ten years from my death
I revoke the bequest to Bertha Williams in the second paragraph of my will and instead thereof I bequeath her one hundred dollars unconditionally as a mark of my gratitude for faithful service by her.
In all other respects I confirm my said will. Dated at the Octagon this 9th day of June A.D. 1901. C. H. Danielle. Signed by the said Charles H. Danielle in our presence, who in his presence and the presence of each other hereby sign our names on the day and year last above written. - R. Watson - Alfred B. Keorins

      I certify the foregoing to be a correct copy of the will and codicil of Charles H. Danielle deceased
