Will of John T. Daly from Newfoundland will books volume 5 page 479-480 probate year 1890 Last Will and Testament This is the last will and testament of me John T. Daly at present of St. John's Accountant. - First. I will and desire that the mortgage which I have and hold on the houses of my late father be foreclosed and the principal and interest realized. If the mortgagors are unable to pay the amount of such principal and interest I direct that my executors shall sell the property and if possible purchase the same in for my estate. The rents of the said houses shall then be paid to my sister Margaret Daly during her lifetime and after her death to my sister Eliza wife of Frederick Burnham and after the death of my said sister Eliza I will and bequeath the said houses and premises to my nephew Ralf Burnham son of the said Eliza. In case my said nephew Ralf should die before his said mother then I will and bequeath the said house and premises to such of the children of the said Eliza as she may by her last will and testament direct and appoint. - Secondly. I bequeath the sum of two hundred dollars to my sister Eliza Burnham Thirdly. I bequeath the sum of forty dollars to the St. Vincent de Paul Society of St. John's (male) Fourthly. I bequeath the sum of forty dollars to the orphanage at Villa Nova 5th. I beneath the sum of forty dollars to the St. Michaels orphanage. Sixthly. I bequeath the sum of forty dollars towards the liquidation of the debt on the hall of the Benevolent Irish Society of St. John's. Seventhly. after the payment of my just debts funeral and Testamentary expenses I will and bequeath the rest residue and remainder of my money and other property to my sister Margaret during her lifetime and after her death to my said sister Eliza Burnham until my said nephew Ralf should arrive at the age of twenty one years when I will and bequeath to him if my said sister Margaret be deceased the sum of one thousand dollars and after the death of my sister Margaret and the payment of the said one thousand dollars to my nephew Ralf as aforesaid I will that the balance be divided amongst the other children of my said sister Eliza in equal proportions and paid them upon their marriage or the death of my said sister Eliza whichever event happens first. Eighthly. I give and bequeath to my sister in law Emma wife of my brother James the sum of forty dollars. Ninthly. In the event of my sister Eliza Burnham having any more male issue born to her I will and bequeath that the bequests hereinbefore mentioned to my nephew Ralf son of the said Eliza should be divided amongst such male issue and the said Ralf it being my intention that the said bequests to Ralf be for the benefit of himself and his brothers male children of the said Eliza.
