Will of Thomas Dalton
from Newfoundland will books volume 14 pages 27-28 probate year 1927

In re
     THOMAS DALTON.     DECEASED.

This is the last Will and Testament of me, Thomas Dalton of White Rock, Smith's Sound, Trinity Bay, Newfoundland, hereby revoking all Wills, Testaments or Codicils by me at any time heretofore made.

I devise and bequeath all my Estate, real and personal, to my executors and trustees hereinafter named in trust for the purposes following:-

Firstly, to pay my just debts, funeral and Testamentary expenses, and thereafter in trust to dispose of and pay over or convey the same to the person or persons or corporations hereinafter named as follows:-

  1. To convey to my two sons, John Dalton, and Lewis Dalton my land on which my estate stands in the following proportions. (a) To my son John Dalton, the portion extending from the center of the boundary line on the back of the land eighty (80) feet beyond where the boundary line of the said John Dalton's land now extends, and from there across the meadow to the other fence forming the East boundary. (b) The portion assigned my son Lewis Dalton to include the remainder of the land toward the Sea across the entire meadow, and the remaining half extending to the back, bounded on the West by Eugene Dalton's Land, and on the East by John Dalton's land.

  2. The Mill, Shop, Store and House and also the Cattle to be my son, Lewis Dalton's. the use of the Mill to be granted John Dalton with Lewis equally.

  3. That my son Lewis Dalton take over the management of the Business; collect and pay all debts connected therewith from time to time.

  4. The money arising from my Life Insurance to be divided equally between my two children, Emma and Lewis Dalton.
    All the rest and residue of my Estate I devise and bequeath to my daughter Emma Dalton, and to Aaron Dalton.

  5. That my daughter Emma Dalton be given the privileges and comforts of the home so long as she remains single and needs them; she is to be supported out of the funds of the estate. In case of her marriage no stranger is to live on the estate.

  6. Aaron Dalton is to be provided for so long as he wishes to remain on the estate until he seeks a home for himself, and to be supported out of the funds of the estate: Emma Dalton is to care for him as if he were a brother.

I nominate, constitute and appoint Lewis Dalton White Rock, Smith's Sound, Trinity Bay, Nfld. Alexander Dalton, White Rock, Smith's Sound, Trinity Bay, Nfld. Fisherman - Farmer - Executors - Ronald Stone appointed Successor and trustees of this my last Will, with full power and authority to sell and dispose of all my estate where necessary, and execute any and all Documents requisite to carry out this my Will, and should one or more of my said Executors or Trustees wish to retire I authorize them to appoint a successor instead thereof.

IN WITNESS WHEREOF, I subscribed these presents as printed and written this 29th day of June A.D. 1921.
