Last will and testament
of Henry Dally of Herring Neck

This is the last will and testament of me Henry Dally of Herring Neck in the district of Twillingate, Newfoundland and now residing at Pike's Arm in the said district a widower living on my income.

First I give devise and bequeath all my shares (fifteen in number) in the Commercial Bank of St. John's Newfoundland with the interest and benefits accruing therefrom to Mary Anne Stuckey wife of Thomas Dally of Herring Neck in the district of Twillingate and Martha Dally daughter of Thomas Dally and wife of Theodore Strong of Herring Neck in the said district of Twillingate to be divided in equal shares half and half each for their absolute use and benefit free from the control of their husbands and free from any expense of charge.

Secondly I give devise and bequeath to Elizabeth (called Betsy) Dally of Herring Neck, widow of William Dally in the district of Twillingate Newfoundland the sum of four hundred dollars in cash current money of Newfoundland free of any charge or expense for her own use absolutely and free from the control of any of her children, out of the monies I leave invested or deposited in the Commercial Bank of St. John's Newfoundland.

Thirdly I give devise and bequeath to my sister Martha Dally, widow of Thomas Stuckey of Herring Neck in the district of Twillingate Newfoundland the sum of four hundred dollars in cash current money of Newfoundland free from any charge or expense for her own use absolutely and free from the control of any of her children out of the monies I leave invested in the Commercial Bank of St. John's Newfoundland My will and desire is that after the death of my sister Martha Dally aforesaid that the four hundred dollars or any part thereof remaining unexpended shall be ????? ????? expenses for his own use and benefit

Fourthly I give desire and bequeath to my nephew Henry Dally son of Thomas Dally, single, of Herring Neck in the district of Twillingate Newfoundland Fisherman and residing in Toronto, Canada, the sum of four hundred dollars current money of Newfoundland in cash for his sole use and benefit free from any charge or expenses out of the moneys I leave in deposit in the Savings Bank at St. John's Newfoundland.

Fifthly I give devise and bequeath to Elizabeth Mary Rice, widow of John Bowden Tucker of North Island Twillingate the sum of two hundred dollars current money of Newfoundland free from any charge or expense in cash for her own use and benefit absolutely out of the monies I have in deposit at the Saving's Bank in St. John's Newfoundland.

Sixthly I give devise and bequeath to my niece Susannah Dally daughter of Thomas Dally and wife of Levi Blandford of Pike's Arm Herring Neck in the district of Twillingate Newfoundland the sum of twelve hundred dollars current money of Newfoundland in cash for her sole use and benefit free from any charge or expense out of the monies I leave in deposit at Edwin Duder's, Merchant Water Street St. John's Newfoundland.

Seventhly I give devise and bequeath to my niece Emily Dally wife of Frederick Sealey of Pike's Arm Herring Neck in the district of Twillingate Newfoundland the sum of twelve hundred dollars current money of Newfoundland in cash for her sole use and benefit free from any charge or expense out of the monies I leave in deposit in the Commercial Bank of Newfoundland.

Eighthly after my before named bequests have been executed and as for the rest and residue of all my monies and property of whatever description I give devise and bequeath to my brother Thomas Dally of Herring Neck in the district of Twillingate Newfoundland for his own use absolutely.

Ninethly. I appoint Revd George S. Chamberlain, clerk in Holy Orders and S.P.G. missionary of Herring Neck and Gibbets P. Thompson Esqr. The Editor of the "Sun" Newspaper, Twillingate, to each of whom I give devise and bequeath the sum of forty dollars current money of Newfoundland in cash for their sole use and benefit free from any charge or expense, to be my executors to this my last will and testament and I hereby revoke all previous wills by me at any time heretofore made. In witness whereof I hereunto set my hand this 31st day of August A.D. 1891. (Sgd) Henry his x mark Dally. Signed by the said Henry Dally the testator by affixing his mark thereto in our presence who in his presence and in the presence of each other at the same time subscribed our names as witnesses. (Sgd) John Solomon Colbourne, Teacher. (Sgd) William F. Coaker, agent.

This is a codicil to the last will and testament of me Henry Dally of Herring Neck in the district of Twillingate, Newfoundland, now residing at Pike's Arm in the said district, which will bears date the 31st day of August A.D. 1891. Whereas by my said will I gave devised and bequeathed various bequests or legacies enumerated in the first eight sections of my said will I now revoke the said sections in part of my said will substituting the following. I give devise and bequeath to the Revd. G. S. Chamberlain clerk in Holy Orders and S.P.G. Missionary at Herring Neck, one years interest on the whole of the property or the monies of which I may be possessed at the time of my decease or the year's interest may be commuted at the option of the various legatees under my last will and testament for an equivalent in a cash payment down; say six hundred dollars currency, and my desire and will is that the amount so realized be devoted by the said Revd G. S. Chamberlain to the various works of charity & piety mentioned hereafter.

First I give devise and bequeath to my step brother James Inkman of Pike's Arm for his sole use and benefit the sum of fifty dollars currency.
Second I give devise and bequeath to my brother Robert Dally now residing at Twillingate the sum of twenty dollars for his own use and benefit.
Third. I give devise and bequeath to Elizabeth, widow of the late Joseph Stuckey and now residing at Pike's Arm the sum of twelve dollars cy. for her own use and benefit.
Fourth I give devise and bequeath to the Revd. G. S. Chamberlain the sum of twenty dollars to be expended as in his discretion he shall think best in repairing Green's Cove School House.
Fifth. I give devise and bequeath to the Revd. G. S. Chamberlain the balance of the amount so realized (say Five hundred and ten dollars Cy) to be expended in the purchase of a new bell, the erection of a belfry, or tower, & in the completion of the new church at Salt Harbour Herring Neck & my desire is that the said bell bear a suitable inscription to perpetrate my memory & that the Revd. G. S. Chamberlain have entire & absolute control over the expenditure of the above amount. But I confirm my said will in all other respects. In witness whereof I hereunto set my hand this 28th day of September A.D. 1891. (Sgd) Henry his x mark Dally. Signed by the said Henry Dally the testator by affixing his mark thereto in our presence, who in his presence and in the presence of each other at the same time subscribed our names as witnesses.
