Last will and testament
of Anne Croke
of St. John's widow Deceased
.

In the name of God amen. I Anne Croke of Saint John's in the Island of Newfoundland widow of the late Nicholas Croke do make publish and declare this paper writing to be my last will and testament and I hereby annul and make void all former wills by me made or executed. First. I give devise and bequeath unto my nephew John Power all my right title and interest of in and to the unexpired term in the land and dwelling house thereon situate on the West side of South West Street in Saint John's aforesaid; the land upon which the said dwelling house is built being leased from Tobins Estate, together with the land upon which the adjoining dwelling is built. The said John Power to pay his proportion of ground rent for the land hereby bequeathed unto him. - and observe and perform the covenants reserved and contained in the lease from Tobins Estate so far as the land hereby bequeathed to him is proportionally liable. - Second. I give devise and bequeath unto the Reverend D. O'Brien at present of Saint John's aforesaid Roman Catholic Priest, or in case of his absence from the colony unto the Administrator of the Roman Catholic Church for the time being all my right title and interest of in and to the dwelling house adjoining and south of the dwelling house named in foregoing bequest; the land upon which the said dwelling house is built being leased from Tobins Estate together with the land upon which the dwelling house in foregoing bequest is built - Upon the conditions that the rents issues and profits arising therefrom after deducting ground rent taxes insurance etc or in case of sale of said dwelling and interest in land aforesaid after paying all liabilities and deducting all expenses that the rents and profits aforesaid (deducting aforesaid) or the purchase money (deducting as aforesaid) shall be applied for masses for the repose of my soul and the soul of my late husband Nicholas Crocke. The said Reverend D. O'Brien or in case of his absence the administrator aforesaid to pay the proportion of ground rent for the land under this bequest and observe and perform the covenants reserved and contained in the lease from Tobins Estate so far as the land under this bequest is proportionally liable. The tenants occupying the dwelling house bequeathed unto my said nephew John Power being Mrs. Mills downstairs and my said nephew John Power (with whom I reside) upstairs. - Third. I give devise and bequeath unto Charlotte Power wife of my said nephew John Power all my furniture of every deception for the benefit of herself her husband and their children. - Fourth. - I give devise and bequeath unto the said Reverend J. O'Brien for his sole use and benefit all other property of every deception whatsoever (including all money) I may die possessed of upon the condition that I am buried in a respectable manner and that he causes to be erected a headstone over the graves of my late husband and myself. Fifth I hereby nominate and appoint the said Reverend D. O'Brien sole executor of this my last will and testament. In witness whereof I have hereunto my hand and seal subscribed and set at Saint John's aforesaid this 12th day of May A.D. 1891 Anne her x mark Croke (L.S.) Signed (by affixing her mark) sealed published and declared by the said Anne Crocke as and for her last will and testament in presence of us and each of us, who have at her request in her presence and in the presence of each other subscribed our names hereto as witnesses (being first read over and explained) M. J. O'Mara John Hearn.
I certify the foregoing to be a correct copy of the last will and testament of Anne Croke.
