In re
MARY COSTIGAN deceased.
This is the last will and testament
of me, Mary Costigan, of St. John’s, Newfoundland, Married woman.
First: I desire that all my just debts and funeral and testamentary expenses
shall be first paid out of my estate.
Second: I appoint my daughter, Margaret
Ellen O’Reilly, sole executrix
of this my will.
Third: I bequeath
all my household goods and furniture to my daughter Katherine O’Toole.
Fourth: I will and direct that my said daughter Katherine
O’Toole shall
be permitted to occupy the portion of the dwelling house on Theatre Hill now
occupied by her at the rent of Sixty dollars per annum so long as she wishes
to occupy and live in the same herself.
Fifth: I will and direct that during the lifetime of my husband, Patrick
Costigan,
the net rental received from my property on Theatre Hill shall be divided into
three equal shares between my husband, Patrick Costigan and my two daughters
Margaret Ellen O’Reilly and Katherine O’Toole.
Sixth Upon the death of my said husband Patrick
Costigan, I give devise and
bequeath the whole of the said property on Theatre Hill to my said daughters
Margaret Ellen O’Reilly and Katherine O’Toole in equal shares as
tenants in common for ever.
Seventh:
All the rest, residue and remainder of my property and estate I will and bequeath
to my two daughters Margaret Ellen O’Reilly and Katherine
O’Toole. Witness my hand at St. John’s
this twenty-third day of June 1915. Mary her X mark
Costigan Signed published and
declared by the said testatrix as and for her last will and testament, who
in our presence and in the presence of the said testatrix and of each other,
all present at the same time, have hereunto subscribed our names as witnesses,
having first been read over to the testatrix and approved by her D.
