Will of Michael Connors Senior Last will and Testament of This is the Last Will and Testament of me Michael Connors of St. John's in the Island of Newfoundland. I hereby revoke all wills by me at any time heretofore made. I nominate and appoint my son Michael Connors to be the Executor of this my last will and testament. I hereby give devise and bequeath unto my said Executor all the property both real and personal, moneys, goods, estate assets and effects of which I may die possessed, with full liberty to my executor to continue my estate as at present invested or to sell and convert the same or any part thereof into money and to invest the sum or sums of money thus arising in his name in such secureties, mortgages, or other investments as he may think fit and to vary the investment from time to time, and to pay and apply the annual income of my estate as follows, namely. First, to apply and pay one half of the annual income of my said Estate to my daughter Ellen for her support and maintenance half yearly until her marriage or death. Second, to apply and pay the remaining half of the said annual income half yearly for the support of my son John or of my said daughter Ellen or towards the support and maintenance of them both in such proportions as my Executor may think fit and I direct that in the application of this half of the income of my estate my executor is to have full absolute and uncontrolled discretion. Third, upon the marriage or death of my daughter Ellen the half of the income first mentioned payable to her shall be applied and paid by my executor at his discretion either to my son John or added to the residue of my Estate to be dealt with in manner and form as the residue of my estate is hereinafter dealt with. Fourth Upon the death of my daughter Ellen to hold the rest residue remainder and reversion of the lands property goods Estate and effects of which I may die possessed upon trust for such of my sons as my daughter Ellen shall by deed or will appoint and in default of such appointment and so far as any such appointment shall not intend in trust for my sons Michael and Frank equally between them and I direct my executor to hold any portion of the moneys belonging to me unexpended at the death of my said daughter Ellen in trust for such of my children or grandchildren as she shall by deed or will appoint and in default of such appointment and so far as any such appointment shall not intend in trust for my sons Michael and Frank provided that nothing in this paragraph contained is to affect any provision which may be made for my son John under the terms of the proceeding paragraphs two and three until the death of my son John I will and direct that all my just debts funeral and testamentary expenses be paid as soon as conveniently may be after my decease. I bequeath to my daughter Ellen upon the death of my son John the half of the income of my estate, mentioned at page one in paragraph two , over which my executor is given a discretionary power, to be paid to her during her lifetime and at her death I direct that the same shall form part of my residuary estate to be therewith dealt with in the same manner as is hereinbefore provided for the distribution of my residuary estate. Newfoundland this twenty ninth day of August AD One thousand eight
hundred and ninety nine and declare the foregoing to be my last Will
and Testament. Signed Published and declared by the
said testator as and for his last Will and Testament in our presence
who in his presence and at his request have hereunto subscribed
ourselves as witnesses I certify the foregoing to be a correct copy of the last will and Testament of Michael Conners deceased D. M. Browning (Listed in the margin next to this will the following) The Petition Michael Connors, To the Honourable the Supreme Court of Newfoundland or one of their
Lordships the Judges thereof. That hereto assureded is the Last Will and Testament of the said Michael Connors and that by the terms of the said Will Your Petitioner was appointed Executor thereof: That said deceased left him surviving as next of kin two daughters namely Ellen Connors and Mary Ann Jardine and four sons namely John Connors, Patrick Connors, Frank Connors, and Your Petitioner and four grandchildren being children of a deceased daughter Margaret Fitzpatrick. That no application for Probate of the said Will or for Administration of the said Estate has been heretofore made. Your Petitioner therefore humbly prays that Your Honourable Court or one of Your Lordships the Judges thereof will be pleased to grant unto Your Petitioner Probate of the said Will. And as in duty bound, Your Petitioner will ever pray. Dated at Saint John's this fourteenth day of November A.D. 1899. (signed) Michael Connors
