In re
Reuben Clarke deceased.
I Reuben Clarke of Battric’s
Island, Back Harbor, Twillingate, North Island, in the Northern District
of the Island of Newfoundland being in ill health, and of sound and disposing
mind and memory, do make this my last will and Testament, hereby revoking
all former wills by me at any time heretofore made
Item.
- My will is that all my just debts
and funeral expenses shall by my executors hereinafter named, be
paid out of my estate as soon after my decease as shall by them be
found convenient
- I give, devise, and bequeath to my beloved wife
Phoebe Clark, all monies deposited in the Bank of Montreal at St.
John’s, all monies
in my possession, that I may be possessed of in my house or that may
be due to me by any person or persons, or that may be otherwise invested
whatsoever at my death for her sole use and benefit, and she is at liberty
and shall have full power and authority to dispose of any monies as she
may wish at her own discretion, also: -
- I give, devise,
and bequeath to my beloved wife Phoebe Clark all my land gardens,
and waterside premises as per diagram annexed, with dwelling house
store outhouses, Flakes, stage, household Furniture and other household
effects, my nets and other fishing gear that I may be possessed of
at my death for her sole use and benefit during her lifetime.
- My will
is that after the death of my beloved wife Phoebe Clarke. I
give devise and bequeath to my son Levi Clark now residing on Battric’s Island,
all my land, gardens, waterside premises as per diagram annexed, with
dwelling house, store house, Flakes, Stage household furniture and other
effects, my nets and any other fishing gear for his sole use and benefit
- providing that if either of my sons viz William Clarke, and Amos
Clarke should return to Twillingate to settle down or reside permanently, they
shall have given to them by said son Levi Clarke,
one third each of the land, gardens, and waterside premises
so long as he or they may reside thereon. but as soon as the
said William Clarke and Amos Clarke or either of them leave
the said land, gardens or waterside premises, the said land,
gardens & waterside premises
shall become the property of the said Levi Clarke for his sole use and
benefit
- And Lastly I do nominate and appoint my two friends William
Thomas Baird,
Blacksmith and Robert Young Planter both of North Island Twillingate
to be the executors of this my last will and Testament
In
testimony whereof I the said Reuben Clarke have subscribed my name
by affixing my mark this twelfth day of July in the year of our Lord
one thousand nine hundred and nine Reuben his x mark Clarke Signed and published and declared by the said Reuben
Clarke, as and
for his last will and Testament, by affixing his mark in the presence
of us, who at his request and in his presence, and in the presence
of each other have subscribed our names as witnesses thereto Chas
