Will of David Marshall Chafe

In re
      David M. Chafe          deceased.

      This is the last will and testament of me David Marshall Chafe of the Goulds Bay Bulls Road and of Petty Harbor Newfoundland planter    I hereby revoke and annul all other and former wills by me at any time made.    I will devise and bequeath to my son Frederic Chafe all my farm situate on the north side of Bay Bulls Road as the same is more particularly described in two grants thereof from the Crown to me dated the twenty seventh day of December eighteen hundred and sixty-two number 1755 and the twenty ninth day of August eighteen hundred and sixty five number 2121 and all houses stables barns buildings out houses and erections of what kind soever on the same and all furniture farming utensils cattle of all kind and goods and chattels thereon or thereto belonging and the appurtenances forever free of all claim by or from all persons whomsoever.

      I will devise and bequeath to my executor hereinafter named in trust for my grandchildren David Marshall Chafe     Henry William Chafe and Frederic S Chafe children of the said Frederic Chafe    All that piece or parcel of land situate to the northwestward of the land above described and separated therefrom by a road which piece or parcel of land by this clause devised is held by me under grant from the Crown Number 1675 dated the seventeenth day of January eighteen hundred and sixty one the same to be held in trust as aforesaid until the youngest of the said grandchildren shall attain the age of twenty one years and to be then conveyed to them absolutely in equal shares as tenants in common.

I will devise and bequeath all and singular my lands houses fishing premises and all buildings and erections whatever - belonging to me and all goods and chattels therein or thereon or thereto appertaining situate in Petty Harbour aforesaid to my said son Frederic Chafe for ever absolutely.

      There being the sum of six hundred and forty dollars and certain interest thereon now due to me by the representatives of the late William Ruby which sum is secured by deed of mortgage of land and premises near said Bay Bulls Road it is my will that my said grandchildren shall be equally interested therein in the sums of fifty pounds currency each and in the interest accruing upon such proportions respectively and that the residue of the interest in the said mortgage (being in the sum of ten pounds currency) and interest proportionate thereto shall belong to my said son Frederic Chafe and that my executor hereinafter named shall hold all monies accruing due to the said three grandchildren and pay the same to them with all interest upon their arriving at the age of twenty one years but that so long as the said children shall remain with and supported by their said father Frederic Chafe all interest accruing or accrued due to each of them or their said proportions of the principal money in the said mortgage shall be the property of the said Frederic Chafe their father and shall go towards their support and maintenance

I will devise and bequeath all that piece of uncultivated land belonging to me situate on the south side of Bay Bulls Road and near Fourth Pond to my said son Frederic Chafe absolutely.    I also will devise and bequeath to my said son Frederic Chafe all my interest in the house and premises held by me and others situate near Dunscomb’s Bridge in St. John’s

      I will devise and bequeath to my executor hereinafter named my two shares of fifty pounds each in the Commercial Bank of Newfoundland to hold the same in trust for the sole and separate use and benefit of my wife Susan during the term of her natural life during which she shall annually receive the interest accruing thereon and at her death I will that the said shares shall be the property of my said son Frederic absolutely.

I will devise and bequeath the sum of money (amounting with interest at this time to about twenty five pounds) due and owing to me by Valentine Williams and Richard Williams being a sum lent by me to them and all interest to accrue due thereon to my said son Frederic Chafe absolutely    I also will devise and bequeath to my said son Frederic all sums of money now due to me in the way of debts which are not herein specifically mentioned.    I declare that the receipt by the said Frederic Chafe my son aforesaid of all or any of the bequests in his favour under this will shall be conditional upon his maintaining and supporting in a proper manner my said wife Susan during her natural life so long as she lives in his house and remains unmarried.

There being now deposited by me in the Newfoundland Savings Bank several sums in the names of my grandchildren Henry William, David Marshall, Frederick S. Mary Jane, Ella Louisa and Sarah Ann and in the name of my deceased grandchild Fanny it is my will that my executor hereinafter named shall forthwith after my decease draw out of the said Bank all the said monies and shall redeposit them there in his own name as trustee for the said surviving children and that he shall hold such sums & all sums to be added thereto as hereinafter mentioned and all interest as trustee for each of them respectively to be paid over by him to them on their attaining the age of twenty one years There being also a sum in the said Savings Bank in my own name    I will that my said executor forthwith after my decease shall take from thence such a sum as with the total of the amounts in the said Bank in the names of the said Henry William Chafe. David Marshall Chafe and Frederic S. Chafe or of the said executor in trust for them shall make a total of three hundred dollars and that the said three hundred dollars be then at once deposited in the said Bank in the name of the said executor as trustee in three sums of one hundred dollars each and in the several names of the said three grand children aforesaid Henry William, David Marshall and Frederic S. Chafe and held by my said executor as such trustee to be paid to the said three grandsons respectively on their attaining the age of twenty-one years. It is my will that out of the sum so deposited in my name in the said Savings Bank the said executor shall also draw the sum of forty pounds currency and shall deposit the same in four several sums of ten pounds each in the names of my said four grand daughters Mary Jane, Ella Louisa, and Sarah Anne and of my grand-daughter Fanny Rosamond as hereinafter stated or in the name of the said executor in trust for them to be paid to them on their attaining the age of twenty one years and lastly that my said executor shall deposit the sum now in the said Savings Bank in the name of my deceased grandchild Fanny with the said sum of ten pounds in his name as trustee for my said grandchild Fanny Rosamond the same to be paid to her on her attaining the age of twenty one years and I make the above bequests to them severally accordingly. I will devise and bequeath the residue of the sum so in my name in the said Savings Bank to my said executor and also all other monies belonging to me for his name as trustee for my said grandchild Fanny Rosamond the same to be paid to her on her attaining the age of twenty one years and I make the above bequests to them severally accordingly.

I will devise and bequeath the residue of the sum so in my name in the said Savings Bank to my said executor and also all other monies belonging to me for his own use and benefit after the payment of all my just debts thereout and funeral expenses and the probate of this my last will and testament.

Lastly    I hereby nominate and appoint my said son Frederic Chafe sole executor of this my last will and testament Dated at the Goulds this twenty-fourth day of November Anno Domini eighteen hundred and eighty-one    David M Chafe. signed published and declared by the said testator David Marshall Chafe as and for his last will and testament in the presence of us the subscribers who in the presence of the said testator and of each other have hereunto signed our names as such witnesses of the due execution hereof on the day and year aforesaid Theo G.
