Robert Connell's Lease to Thos. Tierney
This Indenture made, agreed and concluded upon this thirty first day of October in the fifty second year of the reign of our Sovereign Lord George the third of Great Britain, France and Ireland, King defender of the faith and in the year of our Lord God one thousand eight hundred and twelve. By and Between Robert Connell of Cat's Cove, Conception Bay, Newfoundland, Planter of the one part and Thomas Tierney Tailor of the other part of Cat's Cove aforesaid.
Witnesseth that the said Robert Connell that for and in consideration of the yearly rent and covenants herein after mentioned and contained which on the part of the said Thomas Tierney are to be kept done and performed hath demised set and to from let unto the said Thomas Tierney, His heirs, Executors, Administrators and Assigns all and singular that plantation which has been heretofore held and possessed by John Kelly lying and being at the centre of Cat's Cove aforesaid bounded on the east by the plantation that Martin Currain now occupies and on the west by the plantation of Timothy Toole all and singular the buildings, fences and fixtures as now are on the premises to have and to hold the said demised premises the said Thomas Tierney, His heirs, Executors, Administrators and Assigns for and during the term of twenty years next ensuing the date of these presents yielding and holding therefore thereby and every year for and during the said term of twenty years hereby granted and the said Robert Connell, his heirs, Executors, Administrators and Assigns as yearly rent for the same the full sum of nine pounds sterling for each and every year aforesaid the first payment whereof to be made on the thirty first day of October one thousand eight hundred and thirteen and so to continue to be made on each thirty first day of October for and during the said term of twenty years hereby granted as aforesaid and it shall and may be lawful that should the said yearly rent not be paid during whereof the same if right ought to have been paid. Being first lawfully demanded that the said Robert Connell, his heirs, Executors, Administrators and Assigns into and upon the said premises or any part thereof may enter and enjoy the whole as in the former state. And also at the expiration of the time as above mentioned, the said Thomas Tierney do yield up the said premises to the said Robert Connell with all such buildings and erections as he have made thereon and also the said Thomas Tierney by paying the said yearly rent and performing all and every of the said covenants which on his part ought to be performed shall and may from time to time and at all times during the term hereby granted peaceably enjoy the premises hereby demised without any interruption whatsoever lawfully claiming by from or under them.
In true testimony where of both parties hath to these presents interchangeably set their hands and seals firmly binding themself to each other under the penal sum of fifty pounds sterling to be paid immediately by whomsoever that may make default in the Covenants and Agreements as above written
Signed and delivered in the presence of us where no stamp paper is used.
The foregoing is a true copy of the original lease recorded this tenth day of April 1815 - done at the request of the within named Thomas Tierney of Cat's Cove and examined by me.
