George Brown to Wm Warren Transfer Silas Knight trust property by order of the Supreme Court for the benifit of his father Nathan Knights creditors

No 39

This indenture made the seventh day of January in the sixteenth year of the reign of our sovereign Lady Victoria and in the year of our Lord one thousand eight hundred and fifty three between George Brown of Bonavista in the northern district of Newfoundland Planter trustee for Silas Knight son of Nathan Knight of Bonavista aforesaid late trader his son in law of the first part William Warren the younger of Saint Johns in the island aforesaid merchant trustee duly appointed by the supreme court of the said island for the insolvent estate of the said Nathan Knight of the other part whereas by a trust ??? date the first day of April in the year of our Lord one thousand eight hundred and fifty one Nathan Knight of Bonavista aforesaid did transfer to ?? the said George Brown all his right title interest claim property and demand both at law and in equity of him the said Nathan Knight over and to his dwelling house situate on my premises his plate, building ground??? there unto upon which he had since erected a small store and two small garden grounds the one in front of mount prospect and the other near the north bank of the brook discharging into the harbour pond at Bonavista aforesaid in trust for his son Silas Knight until he should reach the age of twenty one years he being then a infant and whereas in accordance of such transfer so made by me I the said George Brown on the fifth day of April in the year of our Lord one thousand eight hundred and fifty one aforesaid executed a deed or declaration of trust in favour of my said grandson Silas Knight ??? of the trust so ??? upon and invested in me by the aforesaid ??? deed of conveyance and whereas the creditors of the said Nathan Knight having since laid a claim to the premises aforesaid during the term of the said Supreme Court held at Saint Johns aforesaid in December last past brought the matter of the said trust before the said court and then and there obtained a decree for the restoration of the premises aforesaid to be applied to the benifit of the creditors of the said Nathan Knight Now knowye that for and in consideration of the circumstances aforesaid and in order to satisfy the just claims of the creditors of the said Nathan Knight as far as the same may go I George Brown of Bonavista aforesaid having agreed to transfer and release all right and claim for which he hath or may be supposed to have in or to the said premises and pieces or parcels of garden ground under the said trust deeds now this indenture witnessed that for and in consideration of the sum of one hundred and ninety two pounds current money of the island aforesaid so due and owing by the said Nathan Knight to William Warren the Younger Phillip Knight and others of Saint Johns as well as at Bonavista agreeable to the schedule ???? unto the Supeme Court and in obediance to the declaration of the said Supreme Court  made therein which discharges and releases me the said George Brown from the trust aforesaid and other part thereof I the said George Brown have bargained sold assigned released transferred and set over and by these presents do bargain sell assign transfer release relinquish and quit claim over the premises and parcels of land aforesaid unto the said William Warren the younger as foresaid trustee appointed by the Supreme Court  for collecting and realigning the estate and effects of the said Nathan Knight in trust for his creditors ??? their executors administrators and assigns all the right title in trust property claim and demand of him the said George Brown ??? where as trustee to Silas Knight aforesaid under the trust deeds aforesaid herein ???? part ?? in trust for the creditors of him the said Nathan Knight and I George Brown do grant and ?? onto the said William Warren the younger his executors administrators and assigns all and singular the said dwelling house store and two lots of garden ground and ??? to the said George Brown comprised and ??? to be assigned to him by the said Nathan knight ??? herein as part ??? deeds of trust or ??? to have and to hold take and dispose by public sale or otherwise the said dwelling house store and gardens and all and singular of that premises hereby assigned sold releashed or mentioned or intended so to be with their and every of their appurtances unto the said William Warren the younger his executors administrators assigns for the purposes aforesaid in trust for the creditors generally as aforesaid of him the said Nathan Knight and the said George Brown or himself his heirs executors administrators and assigns do hereby promise and agree ??? and to the said William Warren his executers administrators and assigns that the said George Brown his heirs executors administrators shall and will from time to time and at all times here after all ???? the said dwelling house store and gardens unto the said William Warren the younger his executors administrators and assigns against him the said George Brown his executors administrators and against all and every person whatsoever shall and will warrent and forever defend.

Nathan Parker Knight of this agreement was married to Ann Brown daughter of George Brown and this George Brown was the son of William Brown Esq and Mary George Brown was also a brother of William Brown of Kings Cove
