This indenture made the fourth of November in the year of our Lord one thousand eight hundred and six between Richard Palmer Attorney to the estate and effects of John Newell late of Harbor Grace in the island of Newfoundland merchant of the one part and Alexander Boucher & Co. of said Harbor Grace Merchants of the other part Witnessth that on the third day of this instant November he the said Richard Palmer did discharge and sell by public auction all the estate and interest of him the said John Newell or his assigns, in and to certain premises situate and being at Harbor Grace aforesaid and late in the occupation of him the said John Newell which premises are held under lease from William Tilly Esquire one particularly and at large described and set forth in the indenture of lease hereunto annexed. And be it known that at the aforesaid public auction, John Smith, Agent for Alexander Boucher &c aforesaid are there and there to and after for the interest of the said lease ??? of two hundred and sixty five pounds, which was a greater or higher price, then any other monies or effects for the same and according to the conviction of the late the said John Smith for the said Alexander Boucher &c became the purchaser. Now this indenture further witnesseth that for and in consideration of the sum of two hundred and sixty five pounds of lawful money of Great Britain to him in hand paid by the said John Smith the receipt whereof he hath hereby acknowledged. He the said Richard Palmer (in the margin of this page - that he hath full power, goods right and lawful and absolute authority to bargain, authorize, transfer and make over unto them the said Alexander Boucher & Co. therein) attorney to the estate and effects of John Newell aforesaid have bargained, sold transferred and made over and by these presents do bargain, sell transfer and make over unto them the said Alexander Boucher &c. their heirs executors administrators and assigns the lease of the before mentioned premises with all the estate term, right title interest and property therein and thereto of him the said John Newell his heirs or assigns on of any person or persons whatsoever acting by from or under him To have and to hold the said premises with all and singular the appurtenances unto them the said Alexander Boucher &c. their heirs executors administrators and assigns for and owing the full and said term of the lease aforesaid and hereunto annexed they the said Alexander Boucher &c. complies with and fulfilling the terms and term of the same according to the true intent and meaning thereof which will fully and at large appear reference thereto being had And the said Richard Palmer do hereby covenant and agree to and with the said Alexander Boucher &c. their heirs executors administrators and assigns the estate term and interest of him the aforesaid John Newell his heirs and assigns in and to the premises before mentioned and heretofore Page 225
