Will of William H. Carter
from Newfoundland will books volume 12 pages 574-575 probate year 1924

In re
      WILLIAM H. CARTER.          DECEASED.

I, William H. Carter, of the Borough of Brooklyn, County of Kings, City and State of New York, do hereby make, publish and declare this as my last Will and Testament, in manner following:

FIRST:-     I order and direct that all my just debts, funeral expenses, and expenses of administration, be paid with all convenient speed.

SECOND:-     I give and bequeath to my brother, Peter S. Carter, my gold watch, platinum chain, and gold knife, presented to me by Lotus Lodge, No. 31. F. & A.M., September 21, 1916, and all my wearing apparel, to and for his own use forever.

THIRD:-     I give and bequeath to my said brother, Peter S. Carter, all my share or interest in and to the law books, furniture and equipment of the law offices of the firm of Carter & Carter, of which he and I are the members, to and for his own use forever.

FOURTH:-     I give, devise and bequeath all the rest, residue and remainder of my property, both real and personal, of every description and wheresoever situated, which I may die seized or possessed of, or entitled to, to my sister, Mary S. Carter, to and for her own use forever, should she survive me; but in case she should not survive me, I give, devise and bequeath to my said brother, Peter S. Carter, all of my said property, should he survive me, to and for his own use forever; but in case he should not survive me, then I give, devise and bequeath to my niece Ethel L. Carter, all of my said property, to and for her use forever.

FIFTH:-     I constitute and appoint my said sister, Mary S. Carter, sole Executrix of this my Will, should she be living at my death, but if she is not then living, I constitute and appoint my said brother, Peter S. Carter, sole Executor of this my Will, should he be living at my death; but if he is not then living, I constitute and appoint my said niece, Ethel L. Carter, sole Executrix of this my will, freeing and releasing my said Executrix or Executor from giving any bond or undertaking for the faithful performance of her or his duties as such Executrix or Executor.
IN WITNESS WHEREOF, I have hereunto set my hand and seal this 31 of May, 1917.

The foregoing instrument, consisting of two typewritten pages, including this page, was on the day and dated thereof, at the County and State of New York, Signed, Sealed, published and declared by the above-named testator as and for his last Will and Testament, in our presence, who, at his request and in his presence, and in the presence of each of us, have subscribed our names as witnesses hereto.
