Will of Peter Hart Carter

Last will and Testament of
Peter Hart Carter of Toronto Province of Ontario
Dominion of Canada.     Clerk deceased

      This is the last will and Testament of me Peter Hart Carter of the City of Toronto in the County of York and Province of Ontario, Railway Clerk, made this fourth day of May in the year of our Lord one thousand eight hundred and ninety two. I revoke all former wills or other Testamentary dispositions by me at any time heretofore made and declare this only to be and contain my last will and Testament. I direct all my just debts funeral and Testamentary expenses to be paid and satisfied by my Executrix hereinafter named as soon as conveniently may be after my decease. I give devise and bequeath all my real and personal estate of which I may die possessed in the manner following that is to say:
Unto my wife Sophia Simms Carter absolutely, provided however that should any part thereof be in the possession of or under the power or control of my said wife at the time of her decease, then I give devise and bequeath the same unto my three daughters Sophia Ada and Emma in equal proportion & share and share alike or to such of them as may be living and unmarried at the decease of my said wife, subject however to the condition that in the event of the death or marriage of any one or more of my said daughters, during the lifetime of any other of my said daughters who is or are unmarried the share of my said daughter so marrying or dying as aforesaid shall revert to and become the property of my said remaining unmarried daughter or daughters as the case may be so that should any one or more of my said three daughters marry or die her share shall go to her two remaining sisters and on the death or marriage of either of the said two remaining sisters, the whole shall go to the last surviving unmarried sister absolutely.
And I nominate and appoint my said wife to be Executrix of this my last will and Testament. In witness whereof I have hereunto set my hand the day and year first above written. (Sgd) P. H. Carter (L.S) Signed published and declared by the said Peter Hart Carter the Testator as and for his last will and Testament in the presence of us who both present together at the same time in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses

Codicil

This is a codicil to the last will and Testament of me Peter Hart Carter of the City of Toronto in the County of York Railway Clerk, made on the fourth day of May A.D. 1892. I give devise and bequeath to my daughter Sarah Sidney Livingstone Lewis and to my sons Samuel Carson Carter, Joseph Simms Carter, Peter Livingstone Carter, and James Oxnard Simms Carter the sum of one dollar each and in all other respects I do confirm my said will. In witness whereof I have hereunto set my hand and seal this eighteenth day of June in the year one thousand eight hundred and ninety six. (Sgd) P. H. Carter (LS) In presence of (sgd) E. Saunders. Toronto (sgd) Edw Penton, Toronto Barrister (sgd) Joseph Tait.

      I certify the foregoing to be a correct copy of a duplicate of the last will and Testament and codicil of Peter Hart Carter deceased.</p>
