Will of Mary A. Carter from Newfoundland will books volume 14 pages 286-287 probate year 1928

In re     DECEASED.
    MARY A. CARTER.

This is the last will and testament of me Mary A. Carter, of St. John's in the island of Newfoundland, Spinster.
First:- I revoke all former wills and testamentary dispositions by me at any time made and I appoint Earl S. Pinsent of St. John's aforesaid the executor of this my will.
Second:- I give, devise and bequeath to my niece Helen Fox all my household furniture and effects for her use and benefit for ever.
Third:- I give, devise and bequeath the following legacies to be paid out of the amount which I may have to my credit in the Bank of Montreal, namely,

  • To Mrs. W. J. Clouston of St. John's widow, the sum of one hundred dollars,
  • To Margaret Paterson daughter of the said Mrs W. J. Clouston the sum of twenty five dollars,
  • To the said Helen Fox the sum of one hundred dollars,
  • To Susan Warren of Herring Neck, an old servant of my family the sum of fifty dollars.
Fourth:- All the rest, residue and remainder of my estate of whatsoever nature and wheresoever situate I give to my said executor to hold the same In Trust to pay the interest dividends and annual income to my brother Edwin S. Carter during his lifetime. On the death of my said brother I give and bequeath my shares in the Colonial Cordage Co Ltd to Jean Fox, Daughter of the said Helen Fox, for her absolute use and benefit for ever, and the rest, residue and remainder of my estate I give and bequeath to the said Helen Fox absolutely and for ever. Should the said Helen Fox die during the lifetime of my said brother Edwin S. Carter I give the bequest in her favour referred to in this paragraph of my will to her said daughter Jean Fox absolutely.
I direct that my executor and trustee may hold as an investment the shares or stocks held by me at the time of my death and any moneys requiring investment under this my will may be invested in any of the following investments with liberty to vary and transpose the same from time to time namely.
(a) Any of the investments for the time being allowed by law for the investment of trust funds.
(b) Mortgages of land in Newfoundland (including leaseholds held for any term of years)
( c) The purchase of freehold or leasehold property.
I declare that my executor and trustees shall not be liable for any loss not attributable to his own dishonesty.
I further declare that my executor and trustee being a solicitor shall be entitled to charge his usual professional charges for work done by him or any partner of his in relation to the trusts of this my will or any codicil hereto in the same manner in all respects as if he were not an executor or trustee.
I further declare that in addition to the above my said executor shall be entitled to charge in addition for his services as Executor and Trustee five per cent on the moneys collected by him whether for principal or interest or dividend.

In witness whereof I have hereunto set my hand at St. John's this 29th day of April A.D. 1924.
