Will of George Hann Cake

In re
      George Cake deceased.

This is the last will and Testament of me George H. Cake of Lamaline in the Southern District of Newfoundland Carpenter I give devise and bequeath the whole of my real and personal estate as follows. I give devise and bequeath unto my beloved wife Bertha Cake during her lifetime or while she remains my widow, and to my son Gilbert Augustus jointly. The house in which I now live with the garden attached and land surrounding the same, also the furniture contained in the said house, a meadow at Salmonier, a meadow known as the “Rocky Wall” meadow a piece of land adjoining Kings at the Beetle Brook a barn and the land on which it stands situate at the Burying Point also cattle and sheep, and all other landed or other property that I may die possessed of including beach and waterside premises. And after my said wife’s death or marriage the whole of the said property is to belong to my said son Gilbert Augustus, and should a son be born to my wife before or after my decease, then the whole of the property aforesaid is to be divided between Gilbert Augustus and the son which may be born as aforesaid share and share alike and should either of my said sons die before their mother or before she marry again then the whole of the property is to go to the one surviving, and should they both be dead then to my daughter or daughters who may be living share and share alike. And it is my will that my daughter Susannah Selina is to have a home with her mother and brother or brothers while she remains single. And should a daughter be born to my wife before or after my decease then Susannah Selina is to have a home as aforesaid only until she is twenty one years old. And the daughter that may be born the same.

I give devise and bequeath to my Executors hereinafter named in trust the sum of five hundred dollars out of money accruing from my Life Insurance Policy No. 94.896 for $700.00 with the Standard Life Insurance Company of Edinburgh Scotland to be invested by them in the Newfoundland Savings Bank for the benefit of my family and it is my will that when my said Executors believe that my said family are in need of money they are to advance them accordingly. And the balance if any after my wife’s decease or marriage is to be divided in the same manner as my other estate.    I give devise and bequeath the balance accruing from my Life Insurance and all other monies or securities for money that I may die possessed of to my wife Bertha Cake for the present support of the family. And it is my will that out of my general estate my executors are to pay the sum of sixty nine dollars to my Uncle Richard Cake of St. John’s Nfld which is the balance due him on the house and land now occupied by me. And lastly I constitute and appoint my beloved pastor the Revd Henry Knight Gilbert and my father in law Benjamin Bonnell Executors of this my last will Revoking and annulling all wills by me at any time made and acknowledging this and no other to be my last will    In witness whereof I have hereunto set my hand at Lamaline aforesaid this ninth day of September Anno Domini nineteen hundred and Six George Hann Cake Signed by the Testator as his last will and Testament in the presence of us present at the same time who at his request and in his presence and in the presence of each other have subscribed ourselves as witnesses John Coady.    Henry Haskell
