Will of Samuel Café
from Newfoundland will books volume 2 pages 322-323 probate year 1858

In re
     Samuel Café      deceased.

In the name of God Amen. I Samuel Café of Little Harbour near Twillingate in the District of Fogo, in the Island of Newfoundland, being very sick in body but of perfect mind and memory thanks be unto God, do make this my last will and testament that is to say first I commit my soul into the hands of God and my body into the hands of my executors to be buried in decent Christian burial and as touching my worldly estate I give and bequeath the same in the following manner,
First I leave and give to my beloved wife Ann my dwelling house and all my pasture land and cattle, i.e. as long as she continues in my name but should she marry or die my five sons Thomas, Richard, John, Abraham and George are to take possession of the above.
Secondly, I leave and give all the cod nets salmon nets and sealing nets herring nets with the room and all the goods and property belonging thereunto and my schooner and all that belongs thereunto unto my beloved wife and my five sons above named the business to be carried on as formerly providing they remain together on the room If any choose to leave the room they thereby forfeit their share in the property, or should my wife die or marry she thereby forfeits her claim (with the exception that one sealing net be given to my son Samuel and one sealing net to my son Jacob and one salmon net and one cod net be given to my daughter Mary Adams immediately on my decease.
Thirdly I give to my son Jacob the grave yard garden.
Fourthly I give to my beloved wife and five sons Thomas & Richard, John, Abraham & George the out gardens viz the Lowland garden and Guldge garden
Fifthly If there be any balance remaining when all my lawful debts are paid the said balance to be given to my son George.
Sixthly, Richard & John are to have my clothes and box and what it contains and to pay to my daughters Susan and Maria £5 pounds cur each.
Seventhly, I do appoint Jacob Wheller and Jonathan Mitchel as my sole executors.

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
