Will of Martha Butt
from Newfoundland will books volume 1 pages 138 & 139 probate year 1831.

In re
     Martha Butt       deceased.

I Martha Butt of Crokers Cove District of Conception bay in the Island of Newfoundland being infirm of body but of a sound mind and memory do this thirtieth day of November in the year of our Lord one thousand eight hundred and eleven make and publish this my last will and testament in manner following that is to say
First I will and direct that all my just debts and funeral expenses shall be fully paid and discharged. Also I do hereby give devise and bequeath unto my niece Jane Parsons daughter of Robert Parsons now of Harbor Grace all that my plantation situate at Crokers Cove aforesaid with the meadows Fishing room Dwelling house, Out Houses and premises thereunto belonging for and during the term of her natural life and in case the said Jane parsons should die without heirs lawfully begotten then and in such case I do hereby give devise and bequeath the same unto the sons and daughters of James Rowe of Harts Content their heirs executors administrators and assigns share and share alike And in case my said niece Jane Parsons should happen to marry my will is that the husband of her the said Jane Parsons shall have no claim act or part in the disposal of the said premises but to be and remain as is before mentioned. Also I do hereby give and bequeath unto my said niece Jane Parsons all my household furniture with all my Cattle Hay and Implements of Husbandry and all other my effects lands goods and chattels and I do hereby nominate constitute and appoint my said niece Jane Parsons whole and sole executrix of this my last will and testament and I do hereby nominate constitute and appoint Thomas Baker and William Lampan both of Harbor Grace Executors in trust to see the due & true performance of this my said last will and testament hereby revoking and making void all former will or wills by me at any time heretofore made declaring these presents to be and contain this my true last will and testament.

Signed sealed published and declared by the testator Martha Butt as and for her last will and testament in presence of us who have subscribed our names as witnesses Jonathan Marshall.   Robert the mark of X Clerk.    Joseph the mark of X Clark.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
