Last Will and Testament of
John Butler of Foxtrap
Farmer deceased.
In the name of God Amen I John
Butler of Fox trap Conception Bay in the Island of Newfoundland
Fisherman and Farmer being very sick and weak in body but of perfect
mind and memory and knowing that it is appointed for all men once
to die do make and ordain this my last will and Testament.
First I give and bequeath to my son Reuben all that
I possess for his sole use and benefit. Viz dwelling house, stable,
cellar, goods and chattels and all my cultivated and uncultivated land.
Second. My son Reuben is to support and do all he
can for his mother during the term of her natural life.
Third. I give to my wife Eliza the piece of cultivated
land in front of my dwelling house during her life and at her death
my son Reuben is to take possession of it.
Fourth I give my son Reuben full power and authority
to give and bequeath all the property that I have given him to whom
he wishes at his death.
Fifth I give to my daughter in law Patience, Reuben's wife the
spinning wheel.
Sixth That piece of land on the west side of the Breakwater road (or
local road) bound on the west by William Butler's
land, east by the Breakwater road, south by Jacob Butler's
land and on the north by land I gave my son Reuben,
the said piece of land I reserve to myself and wife during the term
of our natural lives after the death of myself and wife my son Reuben is
to take possession of it.
And I do hereby utterly disallow revoke and disannul all and every
other former Testaments and wills by me in anywise before named willed
and bequeathed, ratifying and confirming this and no other to be my
last will and Testament. In witness whereof I have hereunto set my
hand and seal this twentieth day of September A.D. 1893 - (Sgd) John
his x mark Butler (LS) Signed Sealed published pronounced
and declared by the said John Butler as his last will
and Testament in the presence of us (having been first read over) who
in his presence and in the presence of each other have hereunto subscribed
our names as witnesses (sgd) Francis F. Furneaux Commissioner
of the Supreme Court of Newfoundland. (Sgd) Isaac Petten.
I certify the foregoing to be a correct
copy of the last will and Testament of John Butler deceased
