In re DECEASED.
ALBERT J. BUTLER.
In the name of God Amen.
I, Albert J. Butler of Foxtrap in the electoral district of Harbour Main in
the Dominion of Newfoundland farmer being in perfect health of body and of
perfect mind and memory do make and ordain this my last will and testament.
First.
I give and bequeath to my son Abram my dwelling house goods and chattles,
stable, cellar, horse, tackling, express and all my agricultural implements.
Second.
I give and bequeath to my two sons William James and Abram all my fishing
gear viz caplin seine, caplin boat, iron work grapnels etc to be divided
equally between them.
Third. To my son Abram I give and bequeath
the land that is situated on Dunns Hill Foxtrap. The said land is bounded
on the north by John Butler, South by Glebe land, East by Job
Ridout and
west by the late John Dawe's land. I give and bequeath to my son Abram the
piece of marsh land (Nanees Marsh) THE SAID piece of land is bounded on the
north by George Jones, South by Edward Kennedy, east by Dunn's Hill road
and west by the river, I give and bequeath to my son Abram that piece of
cleared land situated in Foxtrap The said piece of land is bounded on the
north by the railtrack, south by John Porter, East by Dunn's Hill road and
west by the river.
Fourth. After all my lawful debts have been
paid the money that may be left over is to be equally divided between my
two sons William James and Abram.
Fifth. I give and bequeath to
my son Abram the land that all the above named erections are on.
Sixth.
I have not given or bequeathed any land to my son William James AS I considered
he did not require any, I am giving him a share of the money I may possess
at my death.
Seventh. If my son Abram's wife died and he married
again and had children of his own body begotten he can give them his property
but if he died and left no issue from his own body begotten all the property
that I have given and bequeathed to him is to go to my grandson Edward son
of William James; but if my son Abram died and left a widow she is to receive
her support off of the property whilst she remains in his name.
And
I do hereby utterly disallow and revoke and disannul all and every other
former testaments wills and bequests by me in anywise before named, willed
and bequeathed ratifying and confirming this and no other to be my last will
and testament. In witness whereof I have hereunto set my hand and seal THIS
10th day of December in the year of our Lord one thousand nine hundred and
twenty five
