Will of Elijah Burry
from Newfoundland will books volume 12 page 262 probate year 1922

In re ELIJAH BURRY.       DECEASED.

This is the last Will and Testament of Elijah Burry of Glovertown in the District of Bonavista. Trader. I Elijah Burry being of sound disposing mind memory and understanding do hereby will devise and bequeath as follows.

  1. I nominate and appoint I. J. Mifflen of Greenspond Stipendiary Magistrate as the sole Executor of this my last will and testament.
  2. Unto my wife Mary a life interest only in all lands owned and possessed by me; also my Dwelling House and household furniture of every description including beds and bedding; also Stores, Shop building, Mill building and the machinery belonging or appertaining thereto; also my general business including Stock in trade, books, and whatever debts may be due and owing me at the time of my death together with implements of trade; also all monies that I may have in Banks and on hand at the time of my death; also whatever Cattle I may have and everything else both real and personal that I may die possessed of and after her death the said property or whatever may be left of it shall go and belong to Eric Sparks, son of the late Nelson Sparks of Glovertown for his only proper use and benefit.
  3. To set at rest any doubt that my exist after my death I order my Executor after paying my just debts and demands also my funeral and testamentary expenses and a reasonable amount allowed by the Court or one of the Judges thereof for his personal services and expenses to transfer the whole entire Estate above mentioned over to my said wife who may use it as she so desires without control of any person and whatever may be left at the time of her death shall go and belong to the above named Eric Sparks.
  4. I revoke all former wills and any distribution of my said property at any time heretofore made and do declare this paper writing to be my last Will and Testament.

Dated at Glovertown aforesaid this Tenth day of June in the year of Our Lord One thousand nine hundred and nineteen. Elijah BURRY.

Note provided by Heather Burry Dodd November 2013 - due to the handwriting, we had originally thought that the name was spelled Elizah but have now changed it to Elijah.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
